My School Wants Me to Leave 3 Weeks Early

My year contract will expirte on March 22nd, and my school wants to replace me now, to have their hiring cycle sync with the academic calander. It make sense.

I told them that I need the money and cannot leave early (considering they just brought this up yesterday). I would love to leave early, but would only do that if they paid me for the time that I was willing to stay.

Would I be justified to hold out for the money I would make until March 22nd? Anyone have an experience like this?

Tell them that you'll leave early if they paid you upto end of your contract date, severance, and airfare. Simple as that.

Yep, as long as you get everything CHuckE mentioned I don't see a problem with it. THey might try to stiff you out of severance and airfare though since you wouldn't work there a full 12 months. I'd make sure to have the cash in the bank and my plane ticket in hand

If you make a deal for airfare, severance, and to paid up to March 22nd, get it all put in writing and signed as well as get them to put the schools official stamp on it. That way if they try to screw you, you can go to the labor board and they won't have a leg to stand on.

What a stingy bunch.

As the others have said agree only if the give you your full pay, severance and airfare home and get EVERYTHING in writing.
Sheesh the lengths some places will go to to save money.

They have to give you 30 days notice. That means that they have to pay you for those days whether they choose to make you work or not.

But if they give him 30 days notice which brings him to the end of his contract do they still have to pay him his severance and ticket home?

Interesting question for the Labour Board. (Dial 1350 press 7 for English)

Could this be classed as one of the infamous 11 month firings?

OP is this your first and only contract with this school?

They have not been stingey yet. They asked how soon I could be ready to leave, with the hopes that I would be eager to leave. I am waiting for them to offer something less than the full pay up until March 22nd and full severence and plane tic.

I posted to see what my postion should be. And I will not take less than what I would have made if I stayed until the 22nd.

They do have to give me 30 days notice, right?

To the op they have to honour your contract, otherwise it would be a Labour board issue, and yes you would win. From my memory I believe if you have worked over 11 months then by Korean Labour law they must pay you your severence. I am convinced I am correct on the final point, there has been a thread on this before, and I am sure that this was stated.

NO!!! You must work a full year to get severance. My old boss tried to do this to me too, and I had them sign a stupid useless contract stating they'd pay me all money owed yadayada.... Stupid boss's wife confided to me one night that they didn't have any money to pay me severance, so of course I chucked a stink and refused to go home early like they wanted me to. Long story short, it took MONTHS to get my money owed, and I needed a friend in Korea to help at the labour board cause if you've left the country you can't do anything.

Unless you have your severance in the bank and flight ticket in your hand DO NOT LEAVE.

The labor board will get you your money if as you say...the facts are correct.
I'd certainly tell your replacement what's going on when you meet him/her.
You should be talking to the school owner about this though. Leave early...sure...just pay all what is due tell them.

You're entitled to everything. A full month's pay for your last month and severence. That would be the first thing I'd bring up with them. Fine, I'll leave early. Pay me though.

It's actually an ideal situation. You have 14 days to leave the country instead of having to go to immi to get an extension. You can make sure they pay you.

Let us know what they do.

I think you have something there though. I think 11th month firings are illegal for the attempts to avoid severance. If you work 11 months, then you don't get severance, but they can't fire you in that 11th month to avoid it. (this of course being hearsay gleaned from hours of reading Dave's)...
