i got my first job here in korea through a recruiter back in south africa.
as i understand it, my new employer used a recruiter in korea, who in turn used a recruiter in south africa. the recruiter is getting a 'finders fee'
if you wanna call it that, from my employer.
when i used the recruiter i signed a contract with them saying that i will pay the recruiter's fee. (this fee is a staggering 500,000won!)
i got an email from the recruiter saying i must pay the recruiter fee by x date.
my thoughts are:
my recruiter is based in south africa.
i am here in korea.
i have a job now and
everything is dandy.
what if i don't want to pay?
what can they do?
i would like to just pocket the money. has anybody done this?
does anybody know what the implications might be if i just give them the
one finger salute? |

OP: Apparently you are a South African citizen who signed a contract and agreed to pay a South African recruiting agency to find you a job in Korea. They fulfilled their portion of the contract and you got the job. Now you are in Korea and you don't want to pay.
It is true that you could have gotten a job in Korea without paying this recruiter, but that isn't the point here. It seems you are legally bound to pay. The consequences of your failure to pay and breach of contract if you don't pay will face you upon your return to South Africa under South African law. You and other South Africans here at Dave's should have the best idea of what you're in for when you go back. |

good question.
the recruiter contract stated in big bold letters:
no contract - no job.
i thought there was a good potential to save money in korea and the recruitment fee was worth it.
newbie learning curve i guess |

well. i dont intend on going back anytime soon.
maybe by the time i do return home, it will be long forgotten.
and even when i do get home, how will they find me?
i doubt they could ever find me. and its a lot of hassle to go through
small claims court for +- $500
what i am more concerned about is what they can do to while i am here.
can they give me any grief while i am here?
do these recruiters have some nasty tricks up their sleeves?
maybe there is like some kinda recruiters mafia and they're gonna break into apartment and lob my nuts off... |

Perhaps it will be worth your peace of mind to pay them, rather than go through the countless sleepless nights of worrying over the nut-lobbing-recruiter-mafiso, which accounts for the waning testosterone levels in the male EFL teachers heretofore marooned and emasculated in the oft-sought-after hagwan hellfire that is this wonderful land of K.

Not fresh on S. African law, but you signed it.
Now, did you sign your contract through the S. African agency, or was your contract sent by a Korean? This MAY matter.
Call a S. African lawyer or get on the efl-law.org site for reputable info. The majority of people on Dave's, including me, aren't law buffs. |
