Hello,

I will be visiting the US with my Korean wife for 3 weeks in July. I need to get her a tourist visa, a non-immigrant visa. I have read on the US Embassy's website that they insist that I apply for an Immigrant Visa if I married a Korean. I will do this in the future. However, I am not going home to live for a long time. There were hints that I should apply for the Immigrant Visa BEFORE I apply for the Non-Immigrant one, but nothing concrete because it is against the law for them to give advice about that.

My question is, has anyone successfully applied for the Non-Immigrant visa for their spouse without applying for the Immigrant one?

My guess is they are concerned people are going to come over on tourist visa's and say, "oh, by the way I'd like to stay."

I haven't done applied for a NI visa for my wife as she is planning to move to the US later this year.

Note that there are two parts to the IV: The first part is kind of a background check and pretty easy to do. Once it's done it's good as long as you two remain married. The second part you shouldn't do until your really sure the two of you are going to move back to the US and stay for awhile. Once you go through with that part, then you'll get the IV and she has to enter the US within six months.

I'd just apply for the tourist visa at this point. It's about $100 and not too difficult to get.

I just got a NIV for my wife about 2 weeks ago.

You do not need to apply for an IV before getting an NIV. If you have any questions about what you need, I'll help. PM me with any questions or my number and you can call me.
