hey everyone!!!

just wondering if anyone can help me out? and im sorry if this question or topic had already been posted.

whats the go in regards to our rights when it comes to sick days? i have been working at my hagwan for 6 months now. about two weeks ago i became very ill and spent 5 straight days in hospital. i worked on a monday, went to hospital on tuesday, was released from hospital the following tuesday, and went back to work on the wednesday. all in all i had 5 working days off.

now one of my co-workers told me that come payday my director will most likely not pay me one cent for the 5 days i hadd away from work. so come judgement day - if the director does not pay me - i am wondering what exactly my rights are here???

does anyone know? or can someone at least tell me who to phone or talk to about this matter? or is it totally fair to not be paid as there is not one word about sick days in my contract?

any help would be much appreciated.

If there isn't anything in your contract about sick days then it's totally up to your boss whether he wants to deduct those days or not.

There is nothing in the Korean labor laws in regards to sick days so basically he doesn't have to give you any if they're not in your contract. Thay are a contractual matter.

I was told by labor that they do have to give you sick days, even if it's not in your contract, I'm not sure how many. The problem is if your boss doesn't want to give them, is it worth the bad blood it will create to take him to labor?

At my company, we don't have any paid sick days. If we are absent, it is deducted from our vacation days or our paycheck. We were previously allowed one sick day per each 3 months with a doctor's note, but our manager thought the foreigners were abusing the system because we actually took those days. The Koreans are required (officially or unofficially) to be here unless they are in the hospital. If they are in the hospital, I don't know if it's deducted from their paycheck or not.

Your director will probably deduct the days, regardless of pay. I have known very, very few Korean managers who will simply pay you out of the goodness of their hearts, even if they seem like "nice" people. You should speak to your directly in a humble way if you are otherwise on good terms, and ask what the sick day policy is. Before that, you should ask your Korean co-teacher what would happen if he/she were in the hospital (would she be paid?).

I believe the law requires a contract to include 5 sick days, but call the labor board to be sure.

i think ill just ask my director and have a chat about it... i agree with some of the advice that its not really worth the blood battle if he decides not to pay... so ill chat to him and take it from there.
