I know... most schools require you to give 30-days notice if you want to leave. However, say for instance, you didn't... what would be the repercussions of that?
A quick overview: Someone with an F4 visa didn't give 30-days notice to CDI and is told that the pay will be held for three months. Is this plausible? The contract doesn't state anything about what would happen if the notice isn't given. Should the ex-employee be entitled to her pay sooner than that?

| When I left CDI in a similar style they paid me but minus one bullshit deduction, the deposit on the apartment. But other than that they paid me within a week of me leaving. |

After working three weeks there (four if you count training), things just weren't working out due to living arrangements. Four hours of commute time a day just isn't worth it. They did offer key money for a place but 5mil in that particular area would either get you something with rent nearing 1mil a month or a crappy place plus their assigned realtor was a liar and very unhelpful. Coincidentally got a much, much better job offer with less stress so took that opportunity... without the 30-days notice.
Nothing super juicy about CDI... sorry. ^^ |

If you quit (F2 / F4) and they try to hold anything back, file a complaint with the labor board.
Then file complaints with pension, medical and the tax office.
CDI skirts the fine edges of the law and often slides by on the wrong side.
Call them on it. You have NOTHING to lose and everything to gain.
And to answer the last question, yes, it should be paid within the calendar month. |

I would also call them on this. I believe that E2 holders who sign a one year contract can get their bonus + airfare deducted from the paycheck (that's in the contract from what I recall), but there is absolutely nothing in there regarding the delay of payment for 3 months as punitive measures.
One important question I would like to ask is if you were working with a branch or a campus (franchise). If you were with a branch, you should not be having these issues with FR/HR. However, if you were working with a franchise, all bets are off, because they are only nominally affiliated (licensed curriculum, textbooks, etc.) with CDI and have very little to do with the management / contract aspect once you're done with training.
Even if you were with a franchise, I'd suggest bringing this issue up with HR / FR at headquarters. Although you are accountable for breaking the contract, you have the equal right to hold them accountable for taking actions that are not specified in the contract as well. Not knowing the specific contexts of your early departure and BM / FM's reaction, I can't guarantee anything, but the 3 month pay delay is unspecified in the contract I signed in Fall '06. |
