A friend of mine was hit by her drunken director last night. I'm seeking some advice on her behalf as she isn't able to post on here. I only know some of the details, but basically the police were called and she has left the job.
The other director of the school has offered to pay her compensation if she doesn't press charges. She will be getting her pay in full tomorrow and the terms of the compensation will be agreed at the same time. How much is a reasonable figure to ask. She has been told 2-3 months wages, i personally think she should push for much more.
Does she need to go to immigration to get her visa cancelled? and how long can she stay in korea after it's been cancelled?
Any advice appreciated. |

All unpaid wages until the end of the contract, severance and return airfare cost as a minimum. If she only had a month left then 3 months is about right, otherwise go for everything that would have been paid had she continued in employment.
3 months pay is a tiny figure... I would rather press charges than accept that. |

| Ask for the rest of your contract pay, severance, and plane tickets. Then I wouldn't press charges. |

| Get off it...she won't see any jail time. Ask for what's left in contract plus severance and plane ticket...also, have pension fund paid in full for the year. If they don't agree, press charges and make sure they know you'll be telling parents as well. Don't let it slide for too long....either get the money quick and leave quietly or go to the police. |

Your bargaining position will be much stronger if you press charges. I'd definitely do it, even if it was a bluff. Make them pi$$ themselves over it for awhile. Maybe threaten to get the newspaper involved. The name of the school should be posted here, of course. A hagwon director that hits (female foreign) teachers? Game Over.
Where is that giant thread, "Hit a Korean Man, Pay 10 mil", or something like that? |

This is the best advice you can get. Sorry I don't agree with the other posters but they sound like they are out for blood and basically want to teach the idiot director a lesson. Of course this is a good thing. But the problem is that getting real justice might not be in the best interests of the teacher. It might be good, but it also might cause problems if she wants to work somewhere else in Korea. Tell your friend to get her money and run. Sometimes it is best to fight and other times take what you can and run.

Get as much as you can. Pressing charges will only make them angry and defensive. You are more likely to get a lot if you don't press charges. Korean "justice" and western justice are pretty much opposite. The poster that suggested getting the rest of the pay/pension/airfare/etc for hte remainder of the contract had a good idea. Don't settle for anything less than 10mil though.
Yes, the school should give her a Letter of Release and go to immi to cancel her visa. then she is free to work again in Korea. After going to immi to cancel her visa, she will have 14 days to leave the country. I suggest she go to immi with the rep from the school, just to be sure everything is done properly. |

Just to clear up any confiusion, the teacher is female and the director is male.
Also she has about 10 months of her contract remaining, so do you think she would be able to get over 20 million out of them?!? I think the 10 million is do-able. I'm worried that she will fold and accept something crappy though. Hopefully reading these posts will encourage her to go for the jugular.
It is absolutely unacceptable. She was had in with Korea now, this is now the second bad experience she's had with as many schools. Albeit, this one being far worse.
I'd like to thank those who have PMed me too. Thanks for the advice, it's been passed on. I'll keep everyone up to date with what happens next. |

Just to add this hagwon is one of those Christian style place where they do prayers and stuff before classes. The director is a 'Christian'.
Sure the mother's would love to hear about the director beating up the teachers.

That's really horrible! I feel so sorry for the girl. BTW, did she end up at the hospital or not? What was the so called "provocation"? Is the director at all apologetic? Can you give a few more details? Thanks.
You might want to throw into the deal that the Director gets help with "anger management". It sounds like they want to do it quietly. Ask for a lot of money and a release letter and then mums the word. Start high and do it quickly. |

reading up on the threads of those who have sued or gone to Labor (Ianinilsan and others) I have to ask how strong is her bargaining position? What I mean is that, they may full well know that it would be problem for her to press charges and wait god knows how long for any response from the courts and then wait for the court to give some meager punishment. What I'm trying to say is that if she asks for a hgh amount, they may call her on it, believing they can wait her out over criminal charges.
Saying that, I say get as much money as possible and plan on other ways to cause problems if he doesn't pay. For example, tell the parents and definitely show pictures of her face with any injuries. Show any evidence to parents. This would be a credible threat. |

| Include a LOR (and a visa cancellation, if Immigration requires one later on) and a glowing letter of reference in your negotiations. If she's staying for another job, that is. |
