Constitution of the United States

Article. II.
Section. 2.


The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.


Within the law not above the law.

I don't think anybody is saying Bush broke the law; we all understand he has the legal right to pardon/commute the sentence of anyone he sees fit.
The point is that Bush has used this power to prevent his political ally from going to prison, even after Libby's appeal was unanimously rejected by a Court of Appeals, with two of the three judges even being Republican appointees.
Governor Bush oversaw a surprisingly huge number of executions while in Texas, and when he was asked why he didn't pardon any of the convicted inmates, he replied,
"I don�t believe my role [as governor] is to replace the verdict of a jury with my own, unless there are new facts or evidence of which a jury was unaware, or evidence that the trial was somehow unfair."

Oh, how the times have changed.
Were there new facts with Libby? No.
Was the jury unaware of any evidence? No.
Was the trial unfair? No. Unlike the hundreds of poor, non-white minorities that were ended under Bush's death machine, Scooter Libby had access to an amazing legal team. A legal team, may I add, that couldn't convince any judge to agree with them.

The message it sends to Americans is clear: Loyal Bushies are indeed above the law. Today public confidence in government has completely bottomed out. This decision will only act as a catalyst in the rapid deterioration of the legitimacy of his presidency..

Democracy as judicial panacea. Good grief. Yes, if you don't agree with any of the egregious violations of civil society/good governance/the law committed by Beltway politicos--99% of whom are intimately familiar with the failures of participatory democracy at holding said violators accountable--just kick the bums out! Kick them all out! Do it now! Don't wait, have a referendum! Have a Referendum Carnival!

The whole thing was a politically driven liberal witch hunt anyway.

I can picture all the liberals typing out emails on thier new iphones..

!!!!s and + + +++s everywhere, with a few OMG thrown in for effect .

I mean, why not? What's going to happen, his poll numbers will drop?

good? Not really corrupt politicians and liars need to be punished!!!!

All this does is show that "liberty and Justice for all" isnt true.. those with money and power are immune.
Bah...a sad day for the US of A seeing such a blatant mockery made of justice.

Just to put things into perspective:

Here is a list of pardons granted by Slick Willie in January, 2001. Just one month...

Pardons for a lot of cocaine offenders and LOTS of other crimes against government and society.

I'm not saying Libby's pardon is right, but to feign shock and dismay and pretend that W is the only president to pardon someone is....well.....assinine.

I think the general tone is that these legal acrobatics never favor the poor everyday Joe, only the rich and politically connected, regardless of party.
