If I get a release letter to start another contract say 15 days early, do I loose my end of contract bonus?

"loose"-as in the opposite of tighten? How does one "loose" a bonus? If you set it free and it doesn't return to you it was never yours kind of thing?

Well, it could be worse, you could be an English teacher......

ha ha! my bad! I benefited from a phase when the wisdom English education establishment decided spelling wasn't very important.. >lose< do I necessarily lose the severance payment?

Contractually you will lose your bonus, but you can still try to negotiate with your boss.

Then you are not entitled to your severance pay if you leave before you have completed your contract.

If you have a nice boss and you have been a sterling employee, he or she may pro-rata what would have been your severance. You'd have to talk to them about it.

Personally, I think your boss is probably rubbing his/her hands together with glee because they don't have to pay your severance or airfare home.

15 days is so little time. Is it really impossible for you to stay till the end and get your severance?

Your "end of contract bonus" is NOT a bonus but a legally mandated severance payment.

Under article 34 of the labor standards act you would NOT be entitled to the severance payment until you have COMPLETED at least one FULL year of employment with the same employer.

Contractually you would not be eligible as you have not completed the contract but terminated early.

Depending on your boss it may be negotiable.

so what happens then if you work for a public school but started a week or two late?

They aren't going to make you come in for two weeks of the beginning of semester yet your holidays are meant to be taken before. So you finish early. Does that still mean that you won't get the severance pay?

Yeah, that's why I haven't mentioned it to them yet. 15 days is a very short time compared to what I have done. It'd be great if they thought - 'ah well, he's done a year, let's let him have it all' but you're probably right, they'd think themselves very lucky that I'd do a year and then.. Mind you, they still owe me holiday..

I'm trying to see if I can swing it with the new contract. The deal they have offered me i to quit my job a month early to do a summer camp (paid) and two weeks training (unpaid). It's going to leave me a month and half out of pocket.

I have written saying I don't want to do the summer camp or the training (that way I can start without quitting early).. I wonder what they'll make of that.

EPIK was notorious for doing this a few years ago - 50 week contracts to avoid the severance on the first year. If you extended and worked the 2nd year you got your severance for both.

I don't have a good answer for you on this one. It will depend greatly on your VP / principal. They may pay it out on contract completion or they may hold to the calendar year as mandated by article 34 and not pay it.

I would guess then that I would be able to insist on staying on for the remaining two weeks or so to complete my contract.

I got this reply:

'Eventhough you counldn't join the summer camp from Aug. 6, you have to join the training session from Aug 16, if you would like to sign on the contract after you see it.



Please reconfirm you are going to join the training session before I email the contract so that you could go over it.




I look forward to hearing from you soon.'




I've got to talk to my current boss to find out how she'll feel about the early departure.

But I'm no longer sure I can be bothered with all this negotiation simply to see the contract and sign it.

Wow, I would at least demand to see the contract before deciding if I was willing to risk my severance.
