how long after your contract ends do they pay your severance

My boss is notorious for saying he will do something and then not do it. my visa ends on the day my contract ends so how am i to know he will pay my end of contract bonus? what day is he supposed to pay it, im leaving korea after my contract ends so if he doesnt pay it then am i just screwed?

Look at Article 34 point 3 of the Severance Pay System below. You are able to request that your boss pay severance in advance of completion of contract. If he says otherwise, he is lying.

Article 34 (Severance Pay System)

(1) An employer shall establish a severance pay system whereby an average wage of more than 30 days shall be paid for each year of consecutive years employed as a severance pay to a retired worker; however, if the worker was employed for less than one year, this shall not apply.

(2) In establishing the severance pay system stipulated in paragraph (1), a differential severance pay system shall not be permitted within one business.

(3) An employer may, at the request of workers, pay severance pay in advance for the period of continuous employment of the worker concerned by adjusting the balances of remunerations before his retirement, irrespective of the provisions of paragraph (1). In this case, the number of years of continuous employment for the computation of severance pay shall be counted anew from the moment the latest adjustment of balances has been made.

That is pretty standard for most hakwons - including the ones I worked for in the past.

also what about plane tickets, how long before my contract ends do they have to buy me one. and if they try and *beep* me can i fight it from outside korea or do i have to stay in and fight it?

And me? My contract ends on the 2nd, but I am supposed to get paid on the tenth. I thought I needed to be out of the country in a few days after my visa expires...

They should square EVERYTHING on your last or 2nd last day of your contract.

YOU MUST be out of the country by MIDNIGHT of the last day indicated on your ARC.

There is NO GRACE PERIOD after your ARC expires.

My ARC expires on 31 August but Immigration stamped my passport to indicate I could stay until 8 September.

The date on your ARC is the date you must leave by.

Immigration will extend it for free if you only need a few extra days, and can show them your exit ticket.

Legally I believe they have up to 30 days after the final day of the contract.

It doesn't, just what I found out by searching. Go to http://www.efl-law.com/forum which will redirect you to the Koreabridge website and look under the Severance forum. That's were I got the info.

Everyday you overstay you will be fined 120,000 won. When you try to leave immigration will expect payment. If you can't pay they will hold you until you can, or so I've heard.
