Hi there,
My boyfriend and I have just accepted a couple's position at the same school, but last week the school asked us if we could start a week earlier than we had originally agreed on. So, we didn't have a problem with this, except now we hear that the school actually only wants ONE of us to start a week earlier. That means that now, taking into account the fact that the school also wants us to come to Korea a few days before our contracts start (for training), this means that one of us will be overstaying their one year visa by almost 2 weeks. Is this allowed? How many days grace do they give you to leave Korea? Or is there a way that the school can somehow extend one of our visas by 2 weeks? Any advice is welcomed! Thanx! |

If your contract goes beyond the allowed period of sojourn (as indicated by your ARC) you simply pop into the local immigration office, pay the 30k won fee and extend the visa for as long as needed.
Not a problem and no worry.
Oh, and there are NO days allowed beyond your visa without an extension.
If you overstay and do not get an extension you will be detained and fined when you try to leave. |

Thanks for the advice - so what I understand from you is that your E2 visa will always actually be a little more than 1 year because it will take a few days for you to get your ARC once you've arrived in Korea. So you're then allowed to stay in Korea until your ARC expires, NOT your visa? Is this right? |

No...
When you get your E2 it will have 2 dates.
One is the date of issue. The other is the expiry date. This will be 90 days after the date of issue. You must enter Korea within those 90 days.
There is another line that says period of sojourn. This will say 1Y (1 year). It means that your period of sojourn (period of allowable stay) is 1 year from the date you enter the country (the date on the entry stamp).
If you want / need to stay longer, then in your 12th month you MUST toddle off to the local immigration office and EXTEND your period of stay for as long as necessary. In the case of a contractual / work extension, they will extend you until the completion date of your contract or contract extension. This can be from 1 day up to 1 year. The cost is 30,000 won.
If you simply need a few days to finalize your affairs (pay bills, close the bank account, do some tourist stuff) before you leave you simply show them your departure ticket and they will extend you for up to 14 days - this is free but you are NOT allowed to work with this free extension.
I hope that clarified things for you. It is a year down the road so no worry, just remember that you will have to visit the immigration office during your last month to get an extension and there is NO GRACE PERIOD (even if your boss tells you later that there is). |

Does anybody know what the fine is if you have overstayed your Visa?
I know someone who has just realized that her school has failed to extend her Visa until the end of her contract. She'll be over by a couple of weeks when she leaves the country. What penalties will she face? |

100k fine, several hour (at a minimum) delay at the airport and a black mark in her immigration file. |

Poster said, "couple of weeks" and the last time I checked couple was about 2, hence my answer.
Y.F is correct that the fines go up substantially after that and can, depending on circumstances, reach 5 million won as an illegal teacher (working after your visa means working as an illegal teacher).

Thanks so much for all the advice - really appreciate it! So we'll just have to head to immigration in our last month (we will definitely get the school to pay for this!!) but we do have one more question:
Surely if there is no grace period (even just a day or 2) then wouldn't almost everybody need to extend their visas? Becuase surely not everybody flies in and starts work on the same day and then flies out the following year on their last day of work? Or is this the case? |

Many people do, but if you just need an extra couple of days past your visa ending date, the extension is free (you can get up to 30 days extnded). |

For real? What's the process? I'm going to be a few days over when I go to do my visa run (having moved to a new location). |

Show a plane ticket out of the country along with your ARC and passport.
They will extend you up to the date of departure.
It is free BUT you are NOT allowed to work on it. |

I have a question too, please
I live in the sticks and my visa runs till the saturday after my last day (friday) at my job
I am leaving Korea for good and my question is this...
Do I need to get an extension of my visa even if I leave as soon as I am ready which would probably be withinn 3 or 4 days after my contract finishes?
Or do I need to get an extension for those few days too?
Seems kinda silly to go all the way to the nearest city to extend my visa for a few days only |

You don't have to visit an Immigration office, you can get an extension online at the Immigration website.
The fine for being even one day 'over' (no grace period) now starts at W500,000.
I posted the following on another thread...
"However, nothing is a simple as it seems -
My latest ARC expired July 31 (same as my contract). I applied for, and was granted an extension of stay online because my air tickets were for Aug. 1. When I checked in at Incheon International, the airline agent wouldn't give me a boarding pass until I went to the Immigration Affairs Office and got a notation on my ARC (to the effect it had been extended). The clerk at Immigration Affairs at first told me it was impossible to get an extension of stay online, and that because I had 'overstayed' by one day, I had to pay a W500,000 fine. When I produced copies of the confirmation of the extension of stay email from Immigration, she started making phone calls. In the end, she put a sticky on my ARC saying it had been extended. Fine... so I go back and get my boarding pass, go through security and get to Immigration where the officer takes my passport and ARC, looks at the date on the ARC and informs me I have overstayed by a day and will have to go back to the Immigration Affairs Office and pay W500,000 to get out of the country! Aaaaaaaaarrrrrrrgh! I tell her to read the sticky attached to my ARC. She does, and starts making phone calls. In the end I was allowed to leave Korea without paying a fine, but only because I had physical proof I had extended my period of stay.
Make hard copies of everything and take them with you. Never assume that because something is done online that it's in the computer system." |
