Hello all. I hope you don�t mind sparing some time to give a newbie some advice. Right now I�m working in Mexico, but I�ve gotten myself into a bad situation, in which I'm losing money working here.
I just emailed a language school director in Korea yesterday. I sent him that email along with my resume, and today he emailed me back that he really wants to hire me to work for him ASAP. Below I've pasted the job ad he posted on Dave's that I responded to, and below that I'm pasting the e-mail he sent me today that has the contract. Is there anything he left out of the contract that I should ask for? What should I try to negotiate for? I'm emailing him to ask for email addresses of other teachers at his school today. I'd appreciate any input you could provide me about this school and contract. I really appreciate it, as I have no contacts in Korea. Thanks again.

Working Conditions

Employment Contract
The two parties agree to carry out the terms of employment as set forth herein. Employer and Employee agree to comply with the following conditions.
1. Schedule
30 hours a week
Classes are scheduled at 2:00 P.M. to 8:00 P.M.
No Splits. No Weekends, No Kindergarten
2. Pay
Employee will pay 2.1 million Won per Month.
Overtime is 20,000 Won each hour.
Tax rate on monthly salary is 3%.
Upon completing the contract, the employer will give the employee a bonus equal to one month regular salary.
3. Airfare
Round trip tickets provided.
4. Housing
Employer agrees to provide a single furnished apartment
which is within walking distance, around 10 minutes from the school. Employee is responsible for the monthly utilities.
5. HEALTH PLAN
The Employer will pay 50% of the premium for the Employee's health plan, which is provided by the Employer and are administered
through the Employer (Participation in a health plan is optional).
The Employee will be responsible for the rest of the costs.
Upon request, the Employer will provide the Employee proof of
health insurance coverage.
6. Vacation
1 weeks paid vacation at the end of the contract+summer and winter school vacation+All Korean National holidays.
7. RENEWAL & TERMINATION OF CONTRACT
1). RENEWAL
1.1 The Employee must give the Employer 30 days notice written before renewal or non-renewal of the Employee's current contract.
1.2 Both the Employer and the Employee reserve the option to renew the contract.
2) TERMINATION OF CONTRACT
2.1 Both parties will give at least 30 days written notice prior
to the termination date of the contract. However, in the
event that either party engages in verbal, physical or psychological abuse against the other party on a continuing basis, this contract may be dissolved without prior notice.
2.2 The Employer retains the right to terminate the contract immediately if the Employer may dismiss the Employee from employment under the following conditions:
a) Violation of the laws of the Republic of South Korea
b) Teaching classes while under the influence of drugs or
alcohol.
c) Being late for class on a continuous basis.
d) Continuous failure to keep regularly scheduled class hours.
e) Repeated absences from classes without a valid reason.
2.3 The Employee retains the right to terminate the contract
immediately if the Employer:
a) Fails to adhere to the terms of this contract.
b) Violation of the Immigration, Labor or other laws of the
Republic of South Korea
2.4 If the contract is terminated before the full completion of the contract period:
Under no circumstances shall the Employer refuse the Employee a letter of release or hinder the Employee from securing future employment in Korea.
8. VENUE FOR DISPUTES BETWEEN EMPLOYER
AND EMPLOYEE
The appropriate laws of the Republic of Korea will govern this contract. However, while both parties enter into this
agreement with total honesty and integrity, disputes may
sometimes occur. In such cases, both parties will be bound by
all terms and conditions of this contract and will
try to resolve the difference in a civil manner that is fair to
both parties. In the event that no solution can be found for a problem and either party decides to terminate this contract.

Looks pretty good. Don't know about the school but i would sign with that. However see if you can get some references from former teachers working there. Ask for some email adresses, that will give you a better prospective. |

It does look like a good contract. As "just because" said, you should ask to speak with a current or previous foreign teacher at the school. If the school's been around a while there is no reason why they can't give you at least an email address. I would be cautious if they don't agree to this.
Oops about the vacation thing - I tend to just skim over the really long posts.

Read it again. It addresses when the vacation is:

Thank you for your responses. They're a big help. I e-mailed the director yesterday, but I haven't heard back from him yet. I wonder if he got my e-mail. It was like 700+ K because it had my scanned passport attached to it. Maybe that was too big of a message to get through. I'm going to e-mail him in a minute or two to check and see that he got it. Howard Roark, that was very astute of you to catch that typo, and yes rapier, I'll do my best to get this contract signed right away and get over there ASAP. Here's a surprise. I asked this language school director for the e-mail addresses of some former or current teachers, and I haven't heard back from him since. It's kind of funny how he went from "We really want to hire you." to absolute silence. Oh well. I guess it was too good to be true. I'll keep trying until I find something. Perhaps he didn't get your email. Perhaps the previous employee was terminated because he was a drunk who blamed Korea for everything that went wrong rather than accept he was a bad teacher. Perhaps he has been busy.

A recruiter just sent me this contract for working at a BCM branch in Changdong. She gave me some lame excuse for not providing me with current or former teacher's e-mail addresses. I guess she didn't feel like doing any extra work for me. I told her I won't sign anything until she provides me with some current or former teacher's e-mail addresses.
There's something in the contract about them reinbursing me for my plane ticket. This is crap, no? Shouldn't they pay for it before I fly over there? I'm also concerned about this statement.

What do you think of this newbie contract? If you were a newbie, then would you take it as is? Would you try to negotiate? If so, then what would you ask for or demand? Thank you.
BCM CONTRACT
1.Position
The Board of Directors of the BCM Language centers (hereinafter referred to as "the BCM Center" ) and
(hereinafter referred to as "the Instructor" ) mutually enter this agreement as set forth in the following statements. The instructor is to be considered a full-time English Instructor of the BCM Center, at the Chang-won School in Chang-won, Korea.
2.Terms of Employment
A) Concerning the Contract:
i) Length of contract: One year contract is offered by the BCM Center to the Instructor beginning on . . 2003 and lasting until . . 2004. Said contract may be extended for a certain number of months or for a one year period at the request of the Instructor with approval of the Board of Directors.
ii) Methodology : The Instructor will teach according to the prescribed methodologies and use the text books specified for all courses. Additional material or books may be used to supplement a course as long as the result is favorable and students respond well to the program. The instructor will be in charge of students that range from pre-elementary school age to adults.
B) Concerning termination of employment
i) Termination notice :
The BCM Center and the Instructor hereby agree to give four(4) weeks notice and a written explanation pending resignation or premature termination of employment and dismissal.
ii) Outside employment:
This contract may be terminated by the BCM Center, and the Instructor dismissed if he/she is found to have other jobs (such as working at other language institutions, tutor or organization) during the term of the contract, without the approval of the BCM Center. This is Korean law.
iii) Conduct:
The Instructor must conduct himself or herself in a professional manner that will not result in damaging the image of the BCM Center. If the Instructor fails to do this, the employer reserves the right to terminate this contract.
iv) If an Instructor has promised to enter employment with BCM Center, and the sponsorship process has already been initiated, and the Instructor cancels the agreement, the Instructor will be prohibited by Korean immigration law to apply for another sponsorship in Korea for the duration of the original sponsorship period(one year).
C) Concerning pay :
The Instructor is to be paid on the 10th of every month.
---- 1 year is 12 month period. ( 1 Month period is about 20 working days)
i) Base pay (for each pay period) :
Each pay period salary of 2,000,000 Won(₩2,000,000) will be paid for up to 120 teaching hours per each month period. Whenever possible, all of the guaranteed hours will be scheduled as teaching hours.
The approximate exchange rate is about 1200 won to 1 U.S.dollar (about 850won to 1 CND). (as of Jan. 2003). This rate fluctates with the market.
ii) Over time pay : The Instructor is to be paid a base pay of 18,000 won per hour for every hour taught that exceeds 120hours within any given pay period. .
D) Concerning the work period
i) Work hours :
The Instructor must be willing to work a split shift. This begins at 6:30 A.M. and ends at 10:20 P.M.(at usually 9:30 P.M.) The instructor will be scheduled to work within this time range. An 120 hours per month(= month period) guarantee is part of this option.
In the event that the actual number of teaching hours scheduled for any particular month is below 120 hours, the Instructor will be required to perform BCM-related work such as editing, creating dialogues, interviewing, etc., to meet the 120 hours for that month(= month period).
If the Instructors are asked to write new materials for BCM, they will be required to sign a waiver forfeiting all rights and privileges to the work performed on BCM's behalf.
E) Concerning the BCM center's Illness or Absentee Policy
i) Illness:
Should the Instructor be absent due to illness, he/she is required to contact the school prior to the beginning of the class or classes to be missed according to the following schedule. 6:30 A.M. classes-notification must be by 5:00 A.M. of the day missed. All other classes-notification must be at least three hours prior to class time.
The BCM Center will then find a substitute instructor for the class or, if such is unavailable, contact the students and cancel the class.
ii) Substitutions:
In the event of a substitution, the Instructor who was absent will teach the same number of hours as the Instructor(s) who substituted. In the event of a cancellation, the Instructor will arrange for those hours to be made up at a later date, after consultation with the class members.
F) Concerning the Code of Conduct:
i) Code of conduct : The Instructor shall adhere to the official BCM Code of Conduct. The professional image of the Instructor and the reputation of BCM Center must be upheld. This includes, but is not limited to, dress and behavior at the BCM Center.
ii) Dress code : The instructor must dress in a professional manner.
(Koreans generally dress conservatively)
iii) Religious beliefs : All religious beliefs of the Instructors will be respected by the BCM Center.
iv) Text books : Textbooks are provided for the instructors and remain the property of the BCM Center. All textbooks must be returned upon termination of employment.
ⅴ)Teaching Plan
3. Befits and Bonuses:
Disclaimer: If the BCM Center or the Instructor , chooses, for whatever reason, to terminate this contract, none of the contractual completion bonuses will be-given to the instructor.
A) Housing :
The institute will provide housing for him/her(a larger room with a double bed for a couple). Instructors are responsible for monthly utilities.
B) Airline ticket:
An instructor must purchase the lowest available Northwest economy class one-way air ticket to come to Korea.(The Instructor does have the option of purchasing a round-trip ticket, but the Instructor would then have the risk of losing the return flight home if they were unable to use it within the one-year time frame. The BCM Center will not be responsible for any ticket loss due to the inability to leave before the ticket expires.)
Upon arrival, the Instructor will be reimbursed for the ticket (with receipt) within 10 days. Upon successful completion of the contract, the Instructor will receive the remaining airfare. The total amount of airfare that the Instructor will receive will be based on the cost of the cheapest available round-trip ticket.
If the Instructor does not finish the contract, the entire amount of airfare already paid to the Instructor by BCM will be returned to BCM Center. This money will be deducted from the Instructor's final paycheck.
C) Annual bonus:
If the Instructor fully honors his/her contract he/she will receive a 2,000,000 won bonus at the end of one-year contract.
D) Concerning Orientation
i) Telephone : The BCM Center will assist in getting the Instructor a telephone. All telephone charges are the responsibility of the Instructor. It is the Instructor's responsibility to recover the phone deposit.
ii) Immigration : The BCM Center will provide instruction and guidance in dealing with the Immigration Office. Instructors are required by Korean Law to obtain an Alien Registration Card.
iii) Health insurance and card: the BCM Center will provide assistance in obtaining medical insurance for the instructor. BCM and the Instructor will jointly (half by each party) make the monthly payments(approximately 4% of the instructor's monthly income). The instructor will be required to return the medical insurance card to BCM upon the termination of this contract. (Each party 50%:50%.)
iv) Savings Account : The BCM Center will assist the instructor in obtaining a savings account at a local bank. The workings of this bank account are the responsibility solely of the Instructor. All expenses incurred by personal banking matters are the sole responsibility of the Instructor.
4. Deductions concerning taxes
i) Korean taxes : Korean taxes are deducted monthly as required by law. (3.3%)
ii) Korean pension plans : The instructor is required by law to participate in the Korean pension plan. 9% will be deducted from the Instructor's salary and put into the pension plan. The BCM Center will contribute 4.5% to the fund for a total of 9%. (Each party 50%:50%.)
iii) Foreign taxes : Any taxes owed to any foreign government are the responsibility of the Instructor. The BCM Center does not involve itself in foreign tax low.
iv) Utilities deposit : 80,000 won will be deducted from the Instructor's salary each month for first five months (1st , 2nd , 3rd , 4th, 5th months). This total of 400,000won will be used to pay any unpaid utility bills that the instructor might have at the time of his/her departure from BCM. 5.Job Description
A) The Instructor must be punctual, relivable and conduct himself or herself in a professional manner.
B) The Instructor must prepare lesson plans for each class and submit one such plan to the Director of Studies.
C) The Instructor will prepare and administer a Mid-term and a Final examination. The results will be evaluated by the Instructor and reported in writing to the Director of Studies.
D) The Instructor must evaluate each student's performance at the end of each semester and report to the findings to the Director of Studies in writing.
E) The Instructor will keep an accurate, current recorded of the student's attendance and performance.
F) The Instructor will attend appropriate BCM Center functions and staff meeting whenever possible.
6.Summary.
I have read and agree to the conditions of employment as an English Instructor at the BCM Center, as set +forth in this contract. In signing this mutual agreement, I understand my responsibilities toward the BCM center and their responsibilities to me, and I accept the position of the basis of this contract.

I personally would not sign this contract without asking for some changes.
I would want the definition of a teaching hour added. Get it added so there are no surprises. Classes may be 50 minutes long and you may believe that constitutes a teaching hour. However, the school may tell you that a teaching hour is 60 minutes of teaching time. This would add 20 hours a month of unpaid work for you if you interpreted a teaching hour to be 50 minutes for example. So get it in writing.
The only other thing that I don't like, but wouldn't be a deal breaker, is the deposit of 400,000 won. You likely won't be able to get the school to change it's position on this and if you want to be a responsible teacher and pay your bills so that the school (or in some cases possibly the next teacher) won't have to cover your phone and heating and maintenance bills, then it's alright.
It's not a bad contract in my view, but the most important change is the teaching hour definition. Whatever you do, don't sign this until that is put into the contract. |

"Back in the day" it was customary in Korea for the employer to play for the ticket up front. Increasingly, they reimburse upon arrival. Legally, the school owes nothing.
At least it's not like Japan yet where the average school only pays for the return flight home, and arriving is your expense.

Many schools usually have a six month period arrival airfare cost. But legally they can do this.

That's fine. My average monthly utility and phone bill cost is around 200,000 a month. I've had months where this has been as much as 350,000 when I went downright silly on the phone (until about two years ago, phone calls from Korea to North American was very expensive at 700 Won a minute).
Besides, it's not easy to pay your bills on the day you leave the apartment without making a lot of calls and individually going to each company to pay the money owed. Unless you plan on doing that, then the bills will have to be paid after you leave. I have no problem with leaving a deposit as it makes sense. If they were asking for a million won, I would be concerned, but 400,000 is reasonable especially if you consider that a teacher could easily skip a paying the bills for a month.

Dude, you've got the expression wrong. It's not "would add 20 hours a month of unpaid work", it's "would mean not getting 20 hours of pay a month and not working". |

About the airfare thing: Just tell them that you have no money and you can't afford to get there unless they pay your way. Simple as that, if they really want you, they will.

I responded to an ad on Dave�s and got a response to it the next day, but there are some things in it that concern me. It makes me wonder if these directors just send contracts out to any-old-one and just hope some fool will bite. I�ve quoted the parts of it that I have a problem with followed by my comments. The contract in full has been copied below these quotes and comments.

I�m confused here. If you decided to stay on for another year, shouldn�t they still owe you your severance payment from your first contract?

OK, I can accept that they wouldn't pay for my airfare home if I quit. But if I just quit it doesn�t look like I�d be getting my last paycheck unless I gave them 2 months notice that I�d be leaving. Is this not also negotiable? What's the standard notice time in Korea?

Well, the last contract I got said 400,000. Gord, I know you said you�d question them about it if it were a million, but is 600,000 not pushing it a bit too far?

Employer and Employee agree as follows :
1. Employee accepts employment from employer to teach the English language under the term and conditions set forths here in this agreement for a period of full and consecutive teaching sessions(a session does not exceed one month). Employment commences from the first day of orientation(............................) and finishes on the last teaching day of employee's twelfth teaching session.
2. Duties
2.1 During the term of this agreement, the employee will be required to prepare for teaching, and carry out all required administrative duties connected with classes assigned by the employer in Monday through Friday. The minimum teaching requirement are 100 teaching hours per month(1 hour is 60 minutes).
2.2 Total teaching hours in excess of minimum requirement is calculated each session as overtime payment. employee is expected to work overtime hours as requested.
Failure to do so constitues violation of the contract.
2.3 Payment made for assigned teaching hours is inclusive of payment for preparation and administrative duties connected with those assigned classes. Employee agrees to take orientation and training, attend meetings and workshops scheduled by employer with no extra pay.
2.4 At all times during the term of this agreement, employee will directly adhere to and obey all the rules and regulations that have been, or may hereafter be established, by employer for the conduct of employee and generally for the conduct of instructors at the place of employment. Conditional on the employee sighting to and agreeing upon the rules and regulations.
3 Compensation and Other Treatment of Employee
3.1 3.2 Orientation and Training : Shortly after arrival in Korea, employee will be required to undertake orientation and training before commencing teaching.
3.3 Severance Payment: Dependent upon completion of the full contract period, the employee will be given an additional 1,900,000won. Korean severance tax will be withheld. In the event that the employee does not renew or extend employment under a subsequent employment agreement with employer, this payment will be made at the time of completion of the contract period.
3.4 Transportation : Employee will purchase an economy class ticket for passage to Korea at an international airport mutually agreed to by employer and employee(henceforth referred to as point of departure). Employer will fully reimburse the cost of the ticket within 11 day from the arrival date. On completion of the full contract period, employer will provide for the employee a ticket for passage from Korea to point of departure.
3.5 Holidays and Vacation : Employee will be entitled to observe public holidays and seven vacation days during the contract term according to a yearly schedule provided by employer before the commencement of the year to which the schedule refers. Employeer will set the dates for vacation
3.6 Sick days : There are two sick days in a year
3.7 Medical Insurance : Employee will be covered by medical benefits under the Korea Medical Insurance Union, a Government Health Organization. The costs of this coverage of 3 % of the employee's monthly salary will be borne half by employer and half by employee. Employee's share of this coverage will be deducted from employee's salary, monthly.
3.8 Accident Compensation : In the event that employee sustains injuries from an accident or mishap which occurs outside the course of normal work duties; employee understands and agrees that employer will have no responsibility for, nor obligation to pay, medical and hospital costs which are in excess of those covered by medical insurance.
4 Dismissal or Voluntary Resignation
4.1 Employer will have the right to dismiss employee for unwillingness or inability to meet conditions of employment as set out under this agreement, for conduct seriously jeopardizing any student or staff person, or for criminal activity.
4.2 In the event that the employee is dismissed, or in the event that the employee voluntarily terminates this agreement, employer will pay salary on the end of the month. 5. Covenants
5.1 Employee hereby agrees, covenants, and undertakes that he/she will not undertake any teaching duties or employment with any persons or organizations other than the employer. To undertake such employment is a breach of Korean Immigration law and can have serious consequences.
5.2 The employee understands and accepts that the rights to use, sale, distribution, or publication of all original material produced by the employee during the course of employee's employment, and for which the employee is compensated as either regular pay, as overtime, or in an agreed-upon lump sum, remain the sole property of employer.
6. Jurisdiction : This agreement will be interpreted according to the internal(domestic) law of the Republic of Korea, A competent court in the Republic of Korea will have jurisdiction in regard to any dispute or claim arising out of, or in connection with, this agreement.
7. Housing
7.1 Employer shall provide a rent free accommodation for employee. Furnishings provided by employer by employee include: A kitchen table and chairs, a two burner gas, hotplate, a refrigerator, a television, and a washing machine. Furnishings provided to employee included a bed, a wardrobe, and a fan. Employee will have to supply his or her own pillow, pillowcase and sheets.
7.2 Employee is responsible for all damage employee causes to accommodation, utility and telephone charges for accommodation provided by employer.
7.3 Employee agrees to a total deduction of 600,000 Won over the period of 1st 3 months of employment as housing management deposit.
