I know this has been discussed before but in my current situation I am a bit confussed. I will finish my contract at the end of next month. At my school we get paid on the 15th of every month. I talked to the other foreign teacher at my school who was recently hired and when he talked to the director he was told that he was going to get his severance when he got his last pay. I was under the assumption you got it before you left the country. I really have no problem with getting paid the next month after my contract finishes as I will be coming back in August but not to have my severance also is a problem because that is a lot of money to leave the country without. I will discuss this with my boss tomorrow and I wanted some advice. Can she do this or is it required that she pay it to me before I leave? I appreciate any advice that you guys can offer. I know my boss will be stubborn about it. Confused

It is standard to get everything you are owed before you leave the country. I'm not sure what the law says, hopefully a more experienced poster will jump on here.

Section 34 of the labor standards act relates to severance pay.

Don't fall for being told they will pay you on next payday after you leave. You must get it, before you leave.

when we get our severance pay
we get the full amount correct? we don't have any taxes taken from it?

Severance pay is subject to a higher tax rate than your salary payments.

really?
now that just really sucks. i know the taxes aren't usually much but still getting the full amount would be nice.

Whether or not one pays tax on their severance varies.
I didn't, but some others have.

By law, tax on severance is at a higher rate than it is on salary.

if u are getting official pay stubs every month that says u are paying taxes, u will probably get hit with the taxes on the severence too. dont forget to apply for ur pension at the pension office b4 u leave the country because that gets deposited into ur home bank account

Go to tax website:

http://www.nts.go.kr/eng/default.html

and hit the "Check your monthly withholding" button and enter the amount which is: You base pay for that month + Severance pay = Total for month.

This will tell you how much they will take out for that last month.
