Here is a contract from Kahn Institute in Seoul, how does it look?
EMPLOYMENT CONTRACT
The following agreement is an employment contract between the employer, Khan Macheon Foreign Language School to be referred to as the institute,. and the employee, D.O.B.( )/ Passport No : to be referred to as the ENGLISH TEACHER.
1. DURATION OF EMPLOYMENT
1) One year contract From( September 1 , 2007 ) To ( August 31 , 2008 )
2) Contract term may be renewed upon mutual agreement.
2. WORKING HOURS, MONTHLY SALARY, OVERTIME RATES & SEVERANCE PAY
1) Teacher will work thirty(30) teaching hours per week Mon. to Fri.
2) Teacher should not work outside of the institute without consent of school director.
3) Teacher will teach wide range of students from children to adults.
4) The Employer will have the authority to assign the Employee some institute and English related nonteaching hours within the limits of total work hours(30hrs per week).
5) Monthly salary is ( 2.0 Million) Korean won. Korean Income taxes(3.3%) will be deducted from the payroll each month. The teacher will be paid at an overtime rate of (18,000)won per hour.
The teacher shall be given ( 2.0 Million ) Korean won as severance payment for successful completion of one year contract period.
6) Salary payments will be paid on the day in which one month teaching session was provided. (payment is on the 5th )
3. HOUSING AND UTILITIES
The empolyer shall provide a rent free furnished house(a single room). Meals are not included.
The cost of monthly service, utility and telephone charges for accommodation should be
paid by the employee.
4. FRINGE BENEFITS & TRANSPORTATION
1) Employer will purchase for the employee an economy class ticket for passage on a
regularly scheduled airline to Korea from an international airport which is mutually
agreed by Employer and Employee (henceforth referred to as Point of Departure). In the
event Employee completes the full contract period , Employer will purchase for the employee
an economy class ticket for on a regulary scheduled airline
from Korea to the Point of Departure.
2) Employee will be covered by medical benefits under the Korean Medical Insurance
Union, a Governmant Health Organization. The costs of this coverage will be borne half
by Employer and half by Employee.
5. BREACH OF CONTRACT
1) If the Employee is found to have outside employment without approval of employer,
this contract may be terminated by the employer. Failure to comply with this article is
cause for immediate dismissal.
2) If the Employee does not honor the 1 year contract, the employee should repay the
reimbursed airfare to school(if the employee purchased the ticket and got reimbursed.) if
this is not the case, the Employer will have no duty and will not be obligated to pay the
cost of return transportation to Point of Departure for Employee, nor will Employer be
obligated to pay any severance pay. If the Employer purchased the ticket for the
employee, Employer will be entited to withhold the amount to the cost of the air fare
provided for travel to Korea.
6. DUTIES OF EMPLOYEE
1) During the term of this Agreement, Employee will accept, obey and comply with the
instruction, supervision, training, and discipline of the employer and will carry out such
assignments as the Employer directs. These duties will include instruction in any and all
phases of the instructional program, preparation for class work, administrative duties
related to the staff employee's classroom duties, attendance at scheduled meetings and
workshops, and any other duties as may be assigned by the employer.
2) Employee hereby agrees, covenants and undertakes that she/he will not disclose
teaching materials, syllabus details, or any other information relation to the academic
program, whether verbal or in written form to individuals or corporate entities not
employed by employer.
7. DISMISSAL OR VOLUNTARY RESIGNATION
1) Employer will have the right to dismiss employee for unwillingness or inabillity to
meet conditions of employment as set out under this agreement, including neglect of
duties. Prior to any such dismissal, Employee will be warned of dissatisfaction
performance or conduct and will be afforded an appropriate period in which to remedy the same.
2) Employer will have the right to dismiss Employee for conduct seriously jeopardizing
and students or staff person, or for criminal activity. In such instances, Employer has the
right under this agreement to execute immediate dismissal and no warning nor time for
remedy need by allotted.
3) In the event that the employee is dismissed, or in the event that the employee
voluntarily resign prior to the termination of the term of his agreement, employer will be
obligated to pay all salary due to date of termination.
8. HOLIDAY , VACATION & ABSENT WORKING
Employee will receive 10 paid vacation days beyond the regular national holidays during
the one year contract term. Vacation can only be taken as scheduled by the Employer.
And in the event that employee is absent, payment will be withheld 150% from the one day's
payment. Or paid vacation days will be deducted by absent days. Non-used vacation days shall not be paid additionally.
9. MEDICAL INSURANCE
The emplotee will be covered by the medical insurance law. 50% of the insurance
premium(about 1.5% of salary) will be paid by monthly deduction from the employee's
salary.
10. The employee has to clean and maintain, according to acceptable standards, the
Employer provided living & working quarters and its concomitant furnishings in preparation for
occupation by new incoming teachers.
Both parties have read the above conditions and agree to the terms in good faith and any dispute arising from matters herein shall be submitted to ultimate judgement of Korea Civil Law.
