My contract states I have to give 60 days notice for resigning. However people have told me they think the law states 30 days. Please clarify  |

You are not legally required to give notice to quit
BUT
IF you signed a contract that says you are required to give 60 days notice then they can hold you to it and you are required to give notice. |

| what if although I have signed a copy i have never seen a counter-signed contract...I have only been at this school for 3 weeks and do not even have a visa yet. I presume I am free to leave at any time before getting a visa. However am just wondering if I do stay here what my legal obligations are. |

I would guess that working without a visa is more illegal than quitting before your contract is up 
Just make sure you get paid before you vanish, else you will never see your cash. |

If you don't have a visa yet AND they have not applied for your visa confirmation number yet, walk out the door the day after payday and don't look back.
Any place that would keep you working for 3 weeks illegally without starting the paperwork to make you legal is not a place you want to trust your other benefits with either (plan to lose your airfare, deposits, severance, pension and national medical benefits.) |

| they have applied for my visa, however the process seems to be taking ahell of a long time. they have had my documents for at least a month now. Do you know the legal side of having another school apply for my visa when an application has already been lodged with immigration? Also, I will have to wait until sept 5 to get paid at which stage i would hopefuly have a visa, meaning I would then have to give the 60 day notice.... |

It takes between 4 and 10 working days to process a visa confirmation number.
If they have taken this long then they have NOT applied for your number and probably won't until they are up against the wall.
Prepare to get fooked. |

Did they take your passport?
If they are holding your passport call your embassy, immediately. |

| they dont have my passport. I have been advised by a part-time recruiter that visa or no visa I'm basically stuffed if the school wants me to be...I don't know how to get around this. |

Not at all. To get that visa, you will have to head to Japan to get it put into your passport, then fly back to Korea. Once you enter Korea with that visa in your passport - THEN it is activated. Until that point in time, you can do whatever you feel like doing.
Forget about the cash they owe you, leave and look for another job. Also recruiters ONLY care about making money, do not trust what they have to say. They would sell their own mothers if it put enough cash in their pocket. To a recruiter you are an investment and income. If you leave, they don't get paid, so they will say WHATEVER is necessary for you to stay.
If immigration finds you are working illegally you are SCREWED. Do you have money to pay if they FINE you 5mil won? It really isn't worth it for some crap job.
