No, it isn't. Already proven with a definition. A police officer claiming someone twisting away from them is "hitting" them is idiotic.
He was elbowing them and when taken down started kicking them. They have bruises to prove it. Whether it was intentional or not it doesn't matter. Injuring a police officer in the line of duty is a felony.

GAINESVILLE, Florida - University of Florida police were justified when
they used a Taser against a student who refused to stop questioning
Senator John Kerry at a campus event, according to a state investigation
released Wednesday.
A 17-page executive summary of the 300-page Florida Department of Law
Enforcement report was released by the University of Florida after some
questioned the use of force against student Andrew Meyer.
The scuffle between Meyer and police started during the Sept. 17 speech
when Meyer refused to leave the microphone after his allotted time was
up, police said. The videotaped altercation and Meyer's cries of "Don't
Tase me bro!" were played frequently on the Internet.

The report says the officers' intent was to escort Meyer from the auditorium, but he broke away and refused to follow the officers' instructions...
Meyer has been charged by police for resisting an officer and disturbing the peace, but the State Attorney's Office has not yet decided whether to file formal charges.
Spencer Mann, a spokesman for the State Attorney's Office, said the decision may be made sometime next week. |

Taser committee urged to tread carefully

During its first forum with the public Monday night, a University of Florida
committee was urged to tread carefully in its response to the
recent Tasering of a UF student.
Continue to 2nd paragraph UF's Committee on a Civil, Safe and Open
Environment has been charged with putting forth recommendations
regarding public events on campus. The committee was formed in
response to the Tasering of Andrew Meyer, a 21-year-old UF student who
was subdued by police when he refused to be physically removed from a
forum with U.S. Sen. John Kerry, D-Mass.
The committee's forum was lightly attended Monday night, with just six
people offering their views. Public notice of the forum wasn't given until
Friday, and some complained that insufficient notice was given to solicit
input from the community.
"This is a bad start to the process," said Joe Courter, who spoke several
times during the forum.

Meyer report filed with prosecutors

The Florida Department of Law Enforcement forwarded a report Friday to prosecutors and the University of Florida about last month's use of a Taser by campus police on a college student, the agency reported.
Continue to 2nd paragraph But FDLE spokeswoman Sharon Gogerty said the report's information and findings would not be released pending a review by the State Attorney's Office in Gainesville.
"There's nothing that we will give out because it is still an open case for us," Gogerty said.
The State Attorney's Office and UF Police confirmed Friday the agencies had received a "lengthy report" from FDLE about the Sept. 17 arrest of UF student Andrew W. Meyer at an on-campus speech by U.S. Sen. John Kerry.
However, spokesman Spencer Mann said prosecutors were not releasing information about what it contained. The agency, he said, would review the report as prosecutors determine whether or not to proceed with a criminal case against Meyer.
UF Police Chief Linda Stump and UF spokesman Steve Orlando also said the report first will be reviewed before it is released.
The report is considered part of a routine administrative review of the use-of-force incident last month, Stump said.
UF is expected to release the report next week.

As per my above post the UF committee has just convened and has been
warned to "Tread Carefully".
Maybe there will be a specific policy to address the use of these deadly
weapons. Maybe it will motivate the legislature to pass some legislation.
Maybe it will induce the department to conduct training, manufacturer
training is like consumer education - have a Coke and a smile. |

Police protest removing Tasers

Roughly a dozen officers from the local and state police benevolent
associations gathered outside Tigert Hall Tuesday morning to support the
use of Tasers by the University of Florida Police Department.
The officers, mostly from UPD, held signs with messages like "Don't
disarm the police" and "Tasers: NOT lethal" while state PBA officials
addressed a small group of reporters.
The officers also decried UF's decision to not include a law enforcement
officer on the committee deciding whether to keep Tasers at UF. The
committee was formed after the controversial Tasering of UF student
Andrew Meyer at a Sen. John Kerry speech last month.
"To us, it makes sense to either include a law-enforcement
representative on the committee, or to do away with the committee
altogether," said Matt Puckett, deputy executive director of the Florida
PBA.
Kim Tanzer, chairwoman of the committee, said that's a decision UF
President Bernie Machen would have to make.
"From my perspective, I would say that our committee includes a
thoughtful, hardworking cross section of the UF community," Tanzer
wrote in an e-mail to The Gainesville Sun.
"At every meeting we invite public comment from people who feel their
positions are not adequately represented in our deliberations," Tanzer
wrote. ". . . In addition we welcome private comments via conversations
or written communications."

Meyer agrees to probation

The University of Florida student who was Tasered by police last month
has agreed to 18 months probation and has said he will leave school for
the rest of the semester, placing a coda on the events that made Andrew
Meyer a household name.
Meyer, who by his own admission "lost (his) cool" during a town hall
forum with U.S. Sen. John Kerry, D-Mass., has issued three letters of
apology, agreed to probation and will pay $150 to charity or do 10 hours
of community service. Meyer chose to take a leave of absence from UF
because the attention the case has brought him has been a distraction,
according to his attorney.
If Meyer meets the terms of his probation, he won't have to face trial
under the deferred prosecution agreement for charges of resisting arrest
with violence and interfering with an educational institution function. If he
fails to hold up his end of the bargain, however, Meyer could be
prosecuted.
