|
|
I have a query regarding overtime pay. I work for GEPIK in an elementary school.
I was of the understanding that if you have less than 22 hrs of regular classes, lets say you had only 20 and you did lets say for example - 4 extra classes that week, you would obviously only get paid for 2 overtime classes as the first two would make your regular hours up to 22.
That's fine.
The question I have is that my school are not giving me overtime pay for my four extra classes one week because we had a Wednesday school vacation day. On Wednesdays I teach four regular classes.
I also teach four classes of overtime a week. They are claiming that as we had a vacation day, then I only taught 18 regular classes that week so plus my four extra classes, that makes it up to 22 classes, so no overtime pay.
BUT, I am sure that at the GEPIK training camp, the supervisor said that if a day off was due to a national or school vacation day, then it WOULD NOT affect overtime pay.
Can anyone confirm or set me right on this please...?
Also, I don't have the notepad where I wrote the number of our supervisor who we can call if we have problems (was her name Wenise or something...?) So if anyone could kindly forward me her name and telephone number, I would appreciate it, so I can call her and clear this matter up.
Many thanks |

Yes. That's what she said, but I was just on the phone with her last week and it's WRONG. Her name is Dain Bae, and I don't have her number either, but I promise you, last week she told me that she was mistaken. Too many elementary schools whined.
Basically, this means paid holidays and sick days aren't. |

But that's paramount to fraud!
Yes, you're right it basically means that I lost out on a paid vacation day. It means they can just save money on paid vacation or sick days by robbing it from your extra classes!
Righty then, I'll tell them that if this is the case, I'll drop the extra classes! |

Believe me, I agree with you. However, they can force you to teach up to 6 hours OT.
Basically, we're all screwed. |

Luckilly my school lets me decline overtime if I want. I've done it with Mother's clases and Eng cafe. I do 4 hrs ot a week and said I will never do more and they said ok.
It differs from school to school though and it shouldn't really.
Anyhow, I still need the name and contact details (email and phone) of our GEPIK co-ordinator / suprvisor if anyone has it PLEASE... |

Nonsense. If you teach LESS than 22 classes per week due to a holiday or a sick day you will (or should) still be paid your full salary. If paid holidays and sick days weren't paid then we would have salary deductions for that. Unless of course you have exceeded your sick days or something like that.
If you teach more you will be paid overtime. But if your classes (EXTRA or not) only make up 22 then you will not get OT.
I don't know why that's so hard to understand. Why would you expect to get overtime for teaching your mandated limit? Once again. Regardless of whether your classes are extra or not, you MUST exceed 22 classes per week to get OT (if that is what the contract states). |

A paid week.
I work everyday, I get paid for my hours EVERYDAY.
OK, four teachers. All of them are sick.
Person A teaches exactly 22 hours a week. He calls in sick Monday, which is usually a 6 hour day.
Guess what? He gets paid for those 6 hours. LUCKY HIM. A PAID SICK DAY. (As, in the contract, it's supposed to be.)
Person B teaches 28 hours a week. She teaches six REGULAR TEXTBOOK classes on Monday and calls in sick. She comes every other day and teaches like normal.
Guess what? She doesn't get paid for those six hours. NO PAID SICK DAYS, DESPITE CONTRACT.
Person C teaches 24 hours a week, 6 regular hours on Monday. He calls in sick and teaches like normal every other day of the week.
Guess what? He only gets paid for 22 hours that week. Meaning he doesn't get paid for 2 hours. NOT A PAID SICK DAY, DESPITE CONTRACT.
Person D teaches 30 hours a week, 6 regular hours on Monday. She calls in sick and teaches like normal every other day of the week. She gets paid for 24 hours, so her sick day is unpaid. NO PAID SICK DAYS, DESPITE CONTRACT.
This applies to holidays as well. |

What are you on? The paid sick day is PART OF YOUR REGULAR SALARY. Meaning when you are sick you do not get a deduction taken off your base pay. So it is a paid sick day because you didn't teach that day but you still got paid in full. Your paid sick day DOES NOT come from OT which you didn't even teach as per your example.
But if your contract mandates that you teach 22 hours a week and YOU ONLY TEACH 22 hours that week...you don't get OT for that week.
Anyway let's look at Person C He teaches 24 hours (6 on monday) and calls in sick. So he only teaches EIGHTEEN hours but gets paid for 22. Just like the contract says.
As for the rest of your people they get paid for 22 hours. But they don't get paid for OVERTIME which they don't even teach.
You don't get paid EXTRA for hours you don't work.

What part don't you understand? Person A gets paid for a paid sick day, everyone else loses hours. If B, C, and D normally get paid SIX HOURS THAT DAY and they DON'T GET PAID FOR SIX HOURS, then they are LOSING TIME. They are NOT paid days!
The best part, though, is Holidays. You work 18 normal hours Monday through Wednesday and 16 hours more Thursday and Friday? Ohp, sorry, you didn't get ANY OT pay BECAUSE SCHOOL WASN'T OPEN.
I can't make it any clearer than that. Either you work for GEPIK or have adopted Korean logic as your system. I've explained it, I'm done with you. |

My point is that they TAKE the OT you DO work and FILL IN THE SICK DAY, meaning the sick time is NOT paid, it's WORKED. |

You are confusing regular hours with OT. Once again. Regardless of how many hours you work per week (up to 22) you get paid for 22 hours. If you work more than 22 hours per week you get paid extra. If you only work 22 hours (REGARDLESS of whether the CLASSES are "regular" or "extra") you don't get paid extra. Why is that so hard to understand? You only get OT if you actually DO OT. You get your base salary regardless. |

Exactly. I SHOULD get the paid sick days / holidays beacause it IS PART OF MY CONTRACT. It is part of a benefit package.
SO if I teach 22 hrs a week but have a day off for national holiday when I usually would have taught 4 hrs that day - I should get my 22 hours PLUS my four hours of OT pay!!!
The_Conservative, you have surely converted to Korean logic.
Imagine back to when you worked in your home country (I'm assuming you have, sorry if you haven't.)
You do a 40 hour week normally.
One week there is a national holiday (July the 4th lets say, or Canada day or... you get my drift.) It falls on a tuesday.
On friday you do six hours of overtime.
For anyone not clued up on how things work in the workplace - this means you get your vacation pay for the day off PLUS your OT PAY!!!
Your boss tries to say, 'well you worked 32 hours (as you had an 8 hr day off for national holiday) plus your six hours OT, so only 38 hours for you this week. But really we'll give you the vacation pay, so it adds up to 40 hrs, so 40 hrs pay for you!
Well you're being RIPPED OFF STUPID!!!!! You've ended up getting only your 40 hr a week paypacket, just cause their was a national holiday, despite it SUPPOSED TO BE PAID REGARDLESS - when you also did six hrs overtime!!!!!!
Come on The_conservative, surely you can see that!!!
Or perhaps, you haven't worked much before... Not a slur on you... I've been working full time jobs for around 13 years at least, so know when I'm being taken for a ride or not....

Note here that I am not trying to defend GEPIK or EPIK or anything else. Just explaining how the system works and WHY it is pointless to get upset over it. |
