|
|
My school has been hemorrhaging students, primarily because of some really seriously stupid decisions made by the husband half of the husband/wife director team. I was supposed to be paid today, and when I went to school I asked some questions of the other teachers, and apparently I was the ONLY teacher paid last month! None of the others were paid at all.
What's my best course of action? My inclination is to say "Call me when I've been paid in full and I'll come back. I'll be at home until then." I'm not afraid of them saying I'm in breach of contract if I do that, because they don't want anything to do with the labor board...I really do hold the upper hand there.
Even though I say that this is my inclination, I'd really like to be more pleasant than that, but I'm also really not interested in working and not being paid.
Ideas? |

Show up tomorrow with a Letter of Release for their signature. All of the foreign teachers there on E-2 visas should do that. Those on F-series visas should just walk. |

It occurs to me that if the OP's employer is afraid of the Labor Board, then the employer has probably lost a case there already. The employer could be in jeopardy of losing their license. |

The Labor Board can DO ABSOLUTELY NOTHING! Take this from a woman who STILL has a judgment from them worth nothing. If you are paid or even mostly paid, get the hell out NOW. My old hogwon had over 30 MILLION won worth of judgments against it but Labor can't enforce jack shit! My old school only closed when the director ran away. Labor board has nothing to do with licensure.
GET OUT NOW. DO NOT PASS GO. DO NOT COLLECT $200. |

I realize that it's the provincial government that has jurisdiction over licensure. But isn't one of the things considered the ownership's appearance record in front of the LB? |

30 million won in judgments in a four month period against my school and the boss NEVER showed up to a single meeting. She called meetinig after meeting but NEVER came.
How often are they relicensed?
In any case, OP should GET OUT. |

You are supposed to take the labor rulings to small claims court and have them enforced. That's what I did. I got my money. With labor ruling in your favor, the courts pretty much just rubber stamp the lawsuit in your favour too.
Labor has the authority to hand down rulings, but not the power to enforce them. That's the court's job. |

I second Frank's post. Take the ruling to the courts and they will make your boss pay. For the system to work you have to go through all the steps. Do pass Go, do collect 30 000 000 Won. |

Yes, which I intended to do, problem is she kept holding up Labor calling meeting after meeting and never showing up. Labor is now telling me that I need to wait, for God only knows what.
And two of my excoworkers took her to court and got the judgment. So what? Did they get the money? Nope. SHE pulled a runner. Nobody knows where she is. They have judgments good for ten years, but no money. I sure as hell don't intend to stay in this country for ten years. |

That's what liens are for. PEOPLE can pull runners, but it's not like they can uproot their residence and take it with them. Go after their property and liquidate it. Exactly what I did. The sight of seeing the jerkoff's wife bawling her eyes out as they carted off the car and apartment electronics is one of my greatest memories here. |

I filed my claim with the court and two month after the filing my old boss skipped town with all the tuition fee from the students. Now I get nothing from my old boss. I could hire a private lawyer, but I would have to stand in line behind 300 parents and bill collectors.
When a hagwon owner rund away with the money, what happens? |

No pay, no work.
Drop a few resumes around town, take a trip to Japan for the day, come back and get another job.
Unless you're broke. Then it's time to call home for a ticket and get out. |

You should have captured the moment on video and posted it on youtube. Anyone who ever worked for a scumbag here would appreciate it. Good job on going for the liens. More people should go this route. |
