If I went Jose Padilla on them, could I get severance for the year(s) I've worked there in addition to my pension contributions?

Yes, I've read the labor code section 37 about private university pension versus public.

What's happened? You're not exactly a newbie getting the screw on a first contract..

[Can I take a guess? Well I'm going to: It's the administration department which is organising your screw-over rather than English professors or whichever department you are working for.]

Is it one of those sudden "Oh yeah, we're not gonna re-new your contract BTW because it would cost our multi-billion won institution an extra 100,000 won a year." Kinda deals? And they left it WAY TOO LATE for you to apply for the first round of other University jobs? And It's not their problem? If so, I'm hoping the same thing doesn't happen to me next year. But it might. There are some seriously insensitive or ignorant people in powerful positions here.

Yes, I've read the labor code section 37 about private university pension versus public.

If you are on national pension, probably yes. If you are on teachers pension or some other private pension scheme, then no.

I have been in a similar situation. I have spoken to Korean lawyers about getting my pension back. As I understand it, getting your severance pay and pension will partly depend on what was written in your contract.

It will also depend on whether you are under a private (Sah hak yeon geum) or public (Gook Min yeon geum) pension scheme.

Under the public pension scheme, collection of your lump sum payment will depend on where you are from.

Give me that info and I can provide you with sound advice.

Some of the Sogang institute teachers did it after they all got fired. They won.

in a word no, people at my univ tried that and according to korean labor an employer does one or the other not both

No, I knew this when I was hired. It's always bugged me, though. And seemed quasi-legal.

I feel your pain. But on the other hand, I've been told that universities are reluctant to approve E-1 visas, because foreigners have sued. If a teacher has more security, it is easier for him/her to sue. Is that true?

Is it really just about trying to save money or are there politics involved? I'm trying to avoid this happening to me as well.
