Hello,

I was told that the Ministry of Education wants all teachers to get a CRC as well. That means that even though I'm on an F2, that I still have to get the background check. Has anybody else heard this?

Who said it? If it doesn't come from immigration then it is nothing more than someone blowing smoke to try and get people to think they know what they are talking about. Kindly tell them if it isn't an official immigration regulation you are nor required to oblige. If they threaten to prevent your employment then you have a clear case of employment discrimination which whether anything is done or not will look very bad for them.

FYI, the MOE and immigration are two different entities. If the MOE wants to make this an official regulation they will have to justify it by going to immigration and stating their case to add a standard that immigration did not implement. That would make the left hand look like it knows better than the right hand does regarding what should be done. In the end it makes them appear to usurp the authority of immigration which is never going to stand for this.

I can go on with other reasons why this is nothing more than rumor and speculation, but I think you get the idea why you should just get the source to verify for you their claim. The whole purpose of the F-2-1 and F5 is to move people towards a more normalized life in Korea as part of the mainstream culture. There are some personal liberty issues that could really create a problem in terms of racial discrimination that will eventually put a big target on Korea as a place to stay away from completely if people do not stop this stupidity.

I'm extending my contract next month. Yesterday my boss told me he 'thinks' I need a CRC from the FBI and to ask my friends about it because he can't get a clear answer from Immi. Rolling Eyes

"He thinks" is just short for I want to exercise my control over you by telling you to do something that is not required of F-2-1 or F5 visa holders. Just tell your boss, the E2 regulations have nothing to do with F-visa holders and thank him for thinking for a change.

The CRC can come from your local police.

If the time comes when I am required to get another CRC it will be from a Korean Police station. I had no criminal record when I came to Korea. I had the CRC done when I first came, and I have lived here ever since. If they want one they will get a Korean CRC. The whole thing has just been blown out of proportion and I am not going to play into this stupidity anymore. As F-2-1, F4 and F5 visa holders you do not have to submit a CRC from your home country because it is not an immigration regulation. If you want to get one, then go ahead and do it, but it is not required. Any job that tells you it is is lying to you. Neither Immigration or the Ministry of Education has made this an official regulation regarding the F-visa holders I mentioned. They (employers and potential employers) will use whatever self-perceived power and authority they think they have to trick and control people. Nothing more, nothing less.

I truly wish that the whole issue could be resolved, but just as soon as someone gives information that is correct, someone else comes up with some contradictory information that further confuses the whole thing once again. Of course you are never going to get a straight answer from immigration or the MOE, but when has that stopped them from doing anything? Regarding the need for a CRC as an F-visa holder, UNLESS you read it for yourself in print then it doesn't exist. These people who are telling you this don't know and they are only trying to scare you into doing what they want you to do. My school has never once asked or told me I need to have a CRC done. They will not because they know it doesn't affect my position because I am an F-2-1 holder.

If your boss or potential employer says "I think" it means they don't know. Ask them to show the information to you in writing that has been translated into proper English and you will happily follow their request. If they cannot, then they are harassing you, and not following the rules of immigration.
