I know the guy who was filmed stumbling and being carried by his friends in the footage shown on EBS about foriengers in hongdae. Most of you may have seen it in the thread

'Foriegners Koreans like and dislike.'

He doesn't have an account here and can't exactly show the footage to his boss and ask him advice... He's actually a decent chap, just drunk too much on his first visit to the infamous Carne Station Wink

Anyway, You'll notice that all other faces are blurred out except from his - much to his indignation.

The question is - is this legal? No one ever aksed him permission to film him or to air his image on EBS.

Furthermore, he said the whole incident had a strange 'set-up' feel to it.

You'll notice the Korean guy he seems to be confronting is just standing there doing nothing. He said it was though they saw him drunk and went near him to try and get a reaction from him.

Anyway, that imo is neither here nor there

Where does he stand legally on this issue...?

Any constructive input gratefuly received.

11 years ago, I was in Japan and was secretly being filmed as a Korean TV actor/comedian talked to me. I had no idea who he was, but they portrayed me and all the Japanese people they secretly filmed that day in a bad light. When I returned from Japan, a few people I knew called me and told me that I was on a popular TV show that was about "Making fun of other people's cultures"...the theme of that particular episode in Osaka was "I want my girlfriend" -basically showing how easy Japanese girls were to meet and bed...the comedian was walking around holding up a sign that read "I want my girlfriend" and trying to engage Japanese girls in conversation. The foreigner element was a last minute addition to the show.

I sued the producer of the show and he settled out of court for an undisclosed amount of cash.

The Korean producer basically took about ten minutes of footage of a conversation and cut & edited and mis-translated what I was saying.

If your friend was filmed without his permission and his face was shown on TV, then he should be able to sue...ESPECIALLY IF THE SHOW OR THEME OF THE SHOW IN ANY WAY DAMAGES HIS ABILITY TO MAKE MONEY BY DEFAMING HIS CHARACTER.

Just need to get a copy of the tape and get an attorney.

In a word or two - yes, obviously. Who wouldn't be upset about being filmed drunk (but doing nothing worng) and the footage (45 secs or so long) being aired on national televison without his permission either to be filmed or for his identity to be show so freely on tv.

Surely this can't be legal...?

Anyone with some common sense and without CC's sense of arrogant high horsedness willing to contribute to the thread...?

Thanks a lot SF. We'll try and get some legal advice during this following week. I personally think the way they invaded his privacy and then aired in on a national tv show is just downright disgusting. He's very embarrassed.

Hell, me, I've done a lot worse, but would still be angry that they took such liberties, if it had have been me.

Hey - if anyone can point us in the direction of an English speaking lawyer or somewhere where we can get legal advice for a free consultation - would appreciate it a lot.

Actually, I take that back. My attorney got me a copy of the tape, I just told him it was Park Chul and SBS. I'll ask my wife if she can dig up the legal info (names, addresses etc) tomorrow. She's on a business trip right now.

I read an account of the same show in which a foreigner was filmed in Japan, and the presenter described the foreigner as apparently homosexual.

The foreigner was awarded 50,000 dollars in court.

How could someone find a legal assistant in his case? Just wondering in case someone starts filming me. Actually people have filmed me when I was out jogging before.

So, you've never seen news programs head down to the stadium after the game and record al the yahoos??

Basically, your guy can feel set up, he can feel a bit taken advantage of, but in the end, if he wasn't acting like an arse, he'd have nothing to worry about.

You nailed it, I think, right on the button: K.B.S. TV did try to arouse your friend and, by extention, show we Foreigners in a negative light. What they did was obviously inethical.

All of us should recall the group of 20 or so Korean males who informed OH My News in early Spring of 2004 that they were patrolling the streets of Hongdae, Shinchon, and I'taewon to look for white or black males in the company of local women.

The Korean males would pick a fight with the foreigner, and when the foreigner defended himself, the group would suddenly turn on a video camera and tape the waegook in an effort to portray him as a savage, out-of-control beast. In fact, this is the same group that attacked the three U.S. G.I.s in May of 2004 and got the Yank to feel that it was necessary to show his shiv to get the local guys to stop their attack. The G.I. got 6 years in jail as a result.

It was obvious to me that your friend was set up. It's thus perfectly understandable that he feels outraged about the incident.

He should sue for as much as possible!!

Yeah. Sue their asses. Make them think twice about making this stupid news pieces in the future. Wow. A drunk man.

And what was that little ferry doing coming up to him anyway?

Makes me think I should get all tanked up, bait them into getting my mug on camera, and then sue the hell out of them. Maybe I'll even go out for a walk and stick my leg out and get nicked by a speeding car and sue them, too. People drive too fast in the back streets in my neck of the woods.

Teach everyone a lesson and fill me pockets.

Boy, us waegooks are sure getting out of hand getting the media in on exposing child abuse at daycares, suing television networks for defamation of character... Next everyone should get on the media's case about the exploitation of foreign teachers by their bosses. Really shove everything down Korea's throat.

Guess it's high time they get all the Apus teaching here 'cause maybe us waegooks be getting out of hand. After all, it's the bad teacher that came first, right? Not the bad school. Uh huh.
