has anyone received an E-2 under new regulations using an apostilled local police background check....(ie. Chicago, Miami, or any other city where you lived most recently in the states)??? |

Did you get the apostille..sometimes a fee , sometimes not depending on the state? Apostille's are given from the Secretary of State and you have to say what country it is for. |

I still think you could have a criminal record in one state and not another and be able to turn in a clean background check. |

My recruiter told me that a county one is fine.
I actually have a misdemeanor in the county I live in now. I didn�t want any problems, so I just went to the next county over and got a clean one.
I still think this system is cracked.  |

I was told by a recruiter that it has to be a national check. This was, of course, after I had an apostilled state CRC in hand. |

If Korean Immigration was smart, they'd question any state or local criminal record check that doesn't match an applicant's U.S. drivers license (or, lacking that, some other evidence like the address on a utility bill). |

since when is it hard to get a drivers license and utility bill in a new state? just move somewhere else for a couple months. |

since when is it hard to get a drivers license and utility bill in a new state? just move somewhere else for a couple months. |
Could a motivated person undergo the hassle and expense of moving to a new state to establish residence there? Yes, but applicants for an E-2 who don't live in Korea are supposed to provide a Korean consulate with work references. If the references are from a different state than the CRC, that should raise a red flag. |

For what this is worth, I was told last night by Rowan from esl-planet that a local check is ok. He seems to think that the rules may change to a national check soon though. So, for now ata least, a local check is ok. I am waiting on both a national FBI check ( I'm a Yankee) and a state (local) check. I thought I should cover all the bases just in case. Hope this helps. |

local check is fine..but needs to be sent to your secretary of state for the SK apostille. some states charge, some do not. but the Sec of State needs to know that it is for SK....different countries ..different apostille's..rules applied due to the .Hague Convention regarding different countries and their agreements. |
