I am pretty sure this is a legit way of doing things, but just want to check. If I can get students to come to the hagwon I work at, do private lessons there, and the funds get channeled through my hagwon (with the help of my boss) so taxes are paid, is this totally legit by the standards of the Ministry of Education? I think this is the one legit way to do it.
I am really fortunate in that I have a hagwon boss who will do this for me AND I actually trust her to do it, so I wanted to see what others know about the idea. |

One question is, does some money stick to the hands of the owner.
I can't understand the reasoning for her to do it absolutely free. Technically you are renting space.
I am assuming that this is not illegal, but i am not sure. |

It's contracted work with your employer, of course it's not illegal.
What if they sponsored you and only one student showed up to class that day. You taught a private lesson. Why would that be illegal? Haha.
Private lessons are not illegal. Self-employed tutoring by an immigrant is what is illegal (if you did it with 5 people at once it wouldn't be "private," yet it would still be illegal) |

It's a very tricky situation. It MUST be done in the school, and you must be paid by your school.

It must be done in the school. Actually, depending on what your school is charging and you are making, it is probably still illegal. The thing is, nobody is every going to make a stink out of it, because you're teaching at your legal workplace. I wouldn't sweat it on your end if it's at your hagwon.
Teaching anywhere privately outside of your workplace is illegal. Even for a hagwon. Even for an F-2 visa or a Korean. I just verified this with SMOE last week. The difference with an F-2 or Korean is that they don't get deported for it. They are still subject to tax laws, if caught. New tax laws against illegal private teaching are half-way through the legislature now, and expected to fly through. Fines equal 5 million won OR 1 year in prison. Crazy, eh? |

I found out that techically it is still illegal if you teach privates at your employer's hagwon because there are laws limiting what they can charge and the rates that make privates worth it violate those laws. They've thought of every which way to make any kind of private lesson illegal or completely unprofitable if you do it legally. If they can't get you comin', they get you goin'... (sorry for not keeping with my namesake on this issue, it's one I find particularly frustrating) |

If you go into the hagwon and look in the directors office you will see a plaque on the wall(if they have it up) listing what the prices should be. If memory serves me correctly it can't be anymore than 90 000 won for elementary and about 100-110 000 for middle/high school students.
I don't know any hagwon that charges that low a rate. The lowest i have ever worked at was 120 000 for elementary and that was 6 years ago.
Every hagwon is breaking that law so you shouldn't worry.
The most you are allowed to charge for a class(or private) inside the hagwon are the prices listed above so I can't see how it isn't profitable. As long as the money passes through the directors hands(or basically they have fiull knowledge and approval of it) you are fine...i have done privates quite a few times through the places I have worked at. |

Why would you want your boss to handle your money for your private lessons? If the boss is cool with you doing privates, do them outside of the haggie and get cash in hand, unless, of course, the students wants a haggie atmosphere. |

No they aren't. If his hagwon hired him to teach one student at a time, that would not be illegal. That is a private lesson. If he normally taught 5 students per day, and four got sick, he is not doing anything illegal, but he is teaching a private lesson.
The only thing that is illegal is self-employed tutoring, private or in groups. Can't you read? |

Dude, who cares if it is illegal?!!! Everyone teaches privates with
the exception of some of these brain-dead 'tards on this board. I
have a pretty wide group of friends and EVERONE of them teaches
on the side.
The only people who get busted teaching illegally are in Kangnam
in Seoul. |

Your working at your assigned place of employment.
I don't think you are breaking any immigration laws.
Consider it O/T make sure you are getting O/T rate or better.
The owner may be operating outside of their charter and whether they
are violating a tax code or education policy is their responsibility not
yours.
At least in a real world that would make sense. |
