I have a new E-2 visa, a new ARC, and have been fired from my job after two weeks. (Why is covered under another thread.)

Is my visa sponsorship tranferable to another employer or do I have to swtart all over?

Do I have to leave the country?
Do I have to pay for another health check?
Do I have to get another ARC?

Does anyone know?

Zaria, as cruisemonkey said, the short answer to all three questions is yes.

Immigration does not allow E-2 holders to change their place of employment unless they are 10 months into a visa. Apparently exceptions are made for transfers to public schools, however, so that would be an avenue well worth exploring. If you can find a public school job, and if Immigration will let you transfer your sponsorship to them, you won't need a new visa or new ARC.

Most likely, however, your current E-2 will be cancelled as of your last day of work (the effective date of your firing). In that case, you'll be given an exit order�a deadline to leave the country. When you leave, you'll have to hand in your ARC to the immigration inspector.

Thus, you'll have to start the E-2 application process all over. Documents will have to be resubmitted, and you'll have to wait for another visa issuance number. You'll take that number to a Korean embassy/consulate to have your visa issued. Since you've held E-2s before, you should be able to go to Japan to have this done. When you enter Korea on your new E-2, you'll have 90 days to get a new health check and apply for a new ARC. New visa = new ARC.

I have a friend who has just come over. Being post March 15th he has to fly home to England because he is not 'in the system' and will have to sort out the interview etc when he gets home etc. BUt we knew that would be the case.

Where this is confusing is that you're two weeks into a new contract and got fired. Have you completed a one year contract before? Or is this your first contract?

Even though you didn't complete this year and have completed a contract previous to this, then surely you are 'in the system'. Regardless of how the last contract went. You've done a year and that's the main thing. They have your details and record of working. Therefore you should only take a visa trip to Japan to get the new E2 visa.

If this is the case then clarifying with Immigration would be the best bet. Or you could email some recruiters and check the situation of what you need to do to get this visa.

Thing is, to my mind the ARC doesn't have any employer info on it, just your number, address and validity dates. If you get a new contract then you'll need to get the new dates put on the card, either that can be in the form of a new card or an extension on the back. It depends.

In a case like this, is a letter of release no longer needed if the original poster does all 3 stated above?
