My E-2 Visa runs out December 31st. I have a flight booked for January 1st, is there going to be any trouble at immigration???

Possibly. I would book the flight a day earlier to safe.

Then again, it may depend on whether you plan on coming back, and how soon.

Well, I guess who should do it would depend on the reason why you are leaving late. Is it because of your employment responsibilities? Then I would agree. If your choice of departure date has nothing to do with the school's schedule, why should they do it?
