I am on my second contract at this school, and my boss is saying he wants to fire me in about 3 weeks, which is 3 months before my contract ends. I worked there for about a year and a half without any major complaints, but about 3 months ago, my boss said I'm getting increased complaints from parents, but he's very vague about what those complaints are. He said he'd pay for an airline ticket, but will not pay my severance. Is there anything I can do to get both? I am going to grad school in August, and was kind of counting on the money to help pay for some of my living expenses.

First off, he cannot let you go with just 3 weeks notice - you have been there more than 6 months so he MUST give you a minimum of 30 days notice or 30 days pay (labor law).

Did you get your severance at the end of the first contract?
-If you did he is NOT obligated to pay you for the 9 months worked since then.
-If he did not, then you ARE entitled to 1 months severance for the full year worked. There is nothing extra for the partial year.

The labor board can help with both cases.

Yeah, I got the severance pay for my first year. I guess it'd be better for me to take an extra months pay instead of an airline ticket, if that's my only option.

Do you know if he has been paying taxes, health care and pension contributions on you? You could point out to him that you had planned on your severance pay. Now that you are being fired abruptly you are going to have to find some other creative ways to scrap up some cash like claiming your pension he probably has paid if he is like most employers here.

As far as I know, he's been paying all of that. I have medical insurance, so I know he's paying for that. How do I find out about pension and taxes?

Call the pension office. They can look you up and tell you how much your boss has been contributing.

I am sorry you are going through a rough time, but bosses sometimes panic and blame things on employees. That is one disadvantage of working at the smaller hagwons rather than at a public school. If you are at a major hagwon that usually tends not to happen.

One more thing. According to my contract, my boss needs to give me 3 official written notices before he can fire me. I've never gotten any.

Also there should be a clause stating that the contract can be scrapped if either party gives thirty (30) days notice. There isn't always the need for the warning system to get rid of somebody.

As Ttompatz said him giving you 3 weeks is illegal, because you should be paid for your whole 1 month notice period or given a months pay, it's a Labour Law.

The National Tax Service has offices all around this nation. You could even give them a ring on the phone for the purpose of exposing this so-called person and arrange an appointment for sharing the details of the story, etc.

I've done this a few times to date, and I'm going to report at least five other Koreans who have ripped me off a.s.a.p.

Immediately call the Tax Office. He might be pocketing your tax money and after you leave submitting your taxes so he can keep your refund. I just found out mine has been doing that. Get that money back in your pocket if you are not registered at the tax office. He will gladly pay you than to submit to a tax audit. You might have him by the balls on this one. Very Happy

Although an employer is supposed to withhold your taxes monthly, he is not required to pay them to the NTS monthly. For small employers, once or twice per year is all that is required. In fact, if a small school pays the money in monthly, the NTS will ask them NOT to pay it in monthly. They do not want to handle the small payments.

Your pension and health insurance are for fixed amounts, the school is invoiced and they must pay monthly or they have to pay a late fee. But not your income taxes. So, even if you're not in the system, your employer can be following the law for taxes.

Ask for the End of Year tax settlement from him or tax office. You might be in for a shock.
