hi all,
am interested in renewing my contract for between 4 to 6months only... as i can't commit to 12months.
is this possible...... or are E2 visa's only issued for mandatory 12month duration?
if it is possible, what do i do next to get this organized?

It shouldn't be a problem if you and your boss are ok with it. He/she can get temporary extensions to your current VISA. Just tell them you are interested in working non contract - no bonus, no perks for the amount of time that you are wanting to stay. I'll hopefully be doing the same at the end of my gig for about 4-5 months. It gives the director some more time to find a relacement and/or have someone there to make the transition easier. |

whats the deal with the bonuses and perks??
what bonuses and perks are you referring to?
are you saying they are not provided on temporary extensions?
i would of thought it would still be ok to:
1) have employer continue to pay 50% monthly into NHIC medical insurance
2) continue to have housing provided
3) receive FULL pro-rata severance pay for period of employment beyond 12 months
4) continue to receive pro-rata vacation time

By perks I'd assume he's referring to severence and airfare.
Employer is legally obliged to pay 50% of pension and medical and obviously you can't live on the street. If you don't go home after the original contract, the original return airfare should still be there.
However, severence is only legally required for each FULL year worked.
It would be possible to work out some sort of arrangement (i.e. cash bonus at the end of the 6months similar to pro-rated severence or so.)
Just make sure you get paid out in full at the end of your original contract - could save more than a few headaches down the line. |

Severance should be given for the same reason as the return airfare. The only "perk" I would give up is vacation time since you aren't working a full year, you shouldn't be given another 10 days off or whatever is agreed to. |

You cannot work "non-contract." Immigration will extend an E-2 for any length of time up to one year. The length of the extension is determined by the new contract. Immigration will not issue an extension without a new contract covering the period of the intended extension.
To the OP: besides a new contract covering the extension period, you'll also have to provide the other documents required by Immi. If you're coming up on the end of your 1-year contract, that means you came before the new regulations were in place. Therefore, you'll have to obtain a criminal background check from your home country and have it authenticated (by apostille back home, or by notarized declaration at your embassy in Korea). You'll also need to fill out a medical self-declaration form (available from the Immi website) and have an employment physical (채용신체검사서, chaeyongsinchegeomsaseo) including TBPE (drug) and HIV tests at a government hospital, general hospital, or public health center. You'll need all these documents, plus some others from your employer, when you or your employer go to Immi to extend your visa.
