I work in a public run high school. It is new and thus far everything has been above board and they are trying to run it as near to the book as they can.
Recently, one of the native English speakers left and a replacement was found. In the interim, a German teacher was hired who has been here for 10 years but is currently only here on a tourist visa.
He went to apply for his F2 as he is married to a Korean and they saw his start date on the contract and the date of his F2 application were two months different, so the German teacher was fined 1.5 million and the school was fined 2 million.
The application for the new English speaker started and then we got a phone call saying that he has a criminal record and they can't process his visa. he denied this vehemently and so my manager went to see them yetserday.
Their story - because of the German teacher, we have essentially broken the law and can't hire anyone on an E2 for a year, even though a different department hired him and he was actually trying to make himself legal.
However, because they know the school was very humble when they paid the fine, and because it is a new school and because it is a government run non-profit making school, they are considering the application again. Also, because the contract was signed before this German descrpancy, they are also going to reconsider.
However, how freaking retarded is that. |

If he's on an F-2-1 he's not required to submit a background check.
Does he have a criminal record in Korea |

The German guy has been in and out of Korea and just kind of forgot to get his F2. I am not sure he fully understands the necessity of having a visa. He works in the German department of the school. The other guy, British, does not have an F2 as he is not married.
My take on it is that the school weren't totally on top of the visa situation as they are relatively new at it and the woman that dealt with it has recently left and the person who has taken over is certainly not on top of it all.
Genuine mistakes made, but hammered by immigration as a result. Also, it is stupid that the school has already paid the fines yet they can't employ someone else for a year. |

What you need to do is legally hire an F-2 (yeah, difficult) and thumb your nose at immigration. |

I've mentioned in prior posts how important it is for teachers to ask about who is handling their paperwork for their visas and this is the exact reason. I've sat across from idiot assistants and been told verbatim what was told to them by immi and so many times it's just a crock.
Kimmi reminds me of the IRS in the U.S. - they go after the little guy, the taxpayer who doesn't know any better and abuse the hell out of them when other people who make so much more get away with so much more.
Kimmi just wants to abuse those who don't know any better, make examples out of them and those caught in the crossfire be damned. It's terrible, the kind of mixed up information, the lack of consistency, the abuse of power that goes on there.
I read on one of these forums Korean Immigration isn't even answerable to any other agency - I don't know if that's correct or not but it seems the first place to start would be to make them accountable for some of the major screw ups they make.
Unfortunately, too many people rollover and take it, instead of saying something about it, and if it's a foreigner who gets shafted, well, we all know how much people here care about that!  |

It seems to me that in this case at least, immigration is being quite reasonable. I'd say it's the school and German teacher who are retarded. He's been teaching in Korea for 10 years and he still doesn't understand the necessity of a visa? How retarded is that? The school doesn't know that they have to get a visa before they put someone to work? Ignorance of the law is no excuse, and the fact that they put someone new in charge is even less of an excuse. The fact that he works in a different department is irrelevant. Its still the same school-employer-sponsor that broke the law. If the prescribed penalty for breaking the law is paying a fine and being barred from sponsoring another E2 visa for a year, then just paying the fine is just part of the penalty and not absolution from the other part of the penalty. It looks like immigration is going to make an exception to the prescribed penalty and allow the school to hire another E2 English teacher. So what are you complaining about? It seems Immigration is being quite reasonable. The retarded school and German teacher broke the law and got themselves into this mess entirely on their own. |

It doesn't say a NATIVE English speaker replaced the native English speaker who left. It's ambiguous and could go either way. Considering German is not as big as English when it comes languages being taught, it's not that much of a stretch to think someone who has lived in the country for 10 years and possibly spoke English well enough but was not a native speaker could teach English in the "interim" until a native English speaker was found or even be hired permanently. |

Well, being an agency of the Ministry of Justice, it stands to reason that it would be overseen by...

... the Minister of Justice.
As I understand it, cabinet-level ministers in Korea are appointed by and serve at the pleasure of the President. I believe they also answer to the National Assembly to a certain extent.
