I am writing for a friend of mine. She has been working illegally while waiting for her school to process her E-2 visa. But last week, the school deducted for taxes, insurance and pension, saying that they have to pay these things whether she is illegal or not. Is this right?
How can they deduct for these items if she is not legal? They cannot pay into the system for her until she is legal, right? Wouldn't they be caught by immigration if they pay in and she's not legal?
She asked for the money back today and was denied.
Any advice would be appreciated. |

What's she gonna do? File a labor board complaint? |

She's getting ripped off. This is yet another good reason why one should never teach until the E-2 is securely affixed in one's passport.
