I wrote a thread on my boss canning me for stupid reasons on th 10th month a few days ago. One thing that he said to me I need verification on though.

He said that because he fired me I must leave korea and not come back and work for 6 months. Is this true?

Are there any restrictions on coming back and such after your cheap boss canned you because he didn't want to pay severance?

I know I have to leave the country in 14 days. But other than that I am not sure of.

Your boss is a liar.

Leave. Hand in your ARC. Find a new job and start again.

Hi thematrixman, your ex-boss is scum. You don't have to wait 6 months to apply for a new visa. There are NO new restrictions on coming back. Was your visa canceled? This applies to the recent changes as well. NO restrictions unless your firing was based upon a crime of some sort that went on record.

You hand it to the immigration officer on your way to the boarding gate. Tell him your job is finished and you're not coming back. He should take your ARC and write "Cancelled" or "Used" on the E-2 in your passport.

So how soon can you return to Korea after being fired and would it be possible to get another job right after you are fired? Basically, after you are fired how long would it take to process another E-2 Visa with the new requirements?

If you are terminated prior to the end of your contract and visa period and receive an exit order from Immigration, you have until the date on that order to depart. It sounds as though they're issuing these with a 30-day deadline these days.

If you complete your contract, you have until the expiration date on your ARC to leave the country. There is NO grace period. If you need an extension, one must be obtained from Immigration in advance. There are two types available:
  • A free extension for up to 30 days for tourism and travel purposes. This extension requires proof of outward travel: an air or sea ticket or confirmed e-ticket receipt. It is not legal to work under the terms of this extension.
  • An extension of one's status of stay (including permission to work) for up to one year. This extension costs 30,000 won and requires the same documentation as any renewal/extension.

I heard that 10-month cannings without good reason can be looked in to by the Labor Board... because bosses don't want to pay severence.

But ... the Labor board doesn't usually give a darn about much.

If the OP intends on returning, there is no need to say anything unless asked, then tell the TRUTH. While it is difficult for hakwon bosses and recruiters to tell the truth, teachers can get along okay with the truth...good luck.

It's not a lie. The job is finished (he no longer has a job) and he's not coming back (i.e., he wants his visa cancelled). If he subsequently comes back, it'll be under a new visa.

I advised the OP to tell the officer he's not coming back in order to ensure that his ARC is taken and his visa is cancelled. If you tell the officer you're returning, they often assume you mean you're coming back on the same visa. Hence, they won't take your ARC and cancel your status of stay.

I'll just say my visa is finished or something.

Anyone know how long it takes for the interview with the korean consulate.

my friend was telling me it can take a few months.
