I am a newbie currently negotiating a contract with my first hagwon. I asked the employer to state in my contract that the employer would provide me with an Alien Registration Card. They told me that this is not in their power. Here is how the exchange went, I have it in writing:

Me: May the contract state that the employer will provide me with an Alien Registration Card?

Employer: Korean Immigration provides this to us, and it is not within the employer's power to provide us with one.

Is this correct? From what I have read on this forum, it seems that it is the employer�s responsibility to provide the employee with the ARC. Am I wrong?

It is not the employer's responsibility to "provide" you with an ARC, nor to obtain one for you.

It is the responsibility of any foreigner staying in Korea more than 90 days to register with Korean Immigration and obtain an ARC.

That being said, you will need the assistance of your employer to register, especially as a newbie. They have to provide certain documents for your application, and you'll also probably also need help getting to the Immi office in the first place. You also have to go to a hospital to get a health check prior to applying for your ARC, and odds are you'll need assistance with that too. In addition, all these things�health check, ARC application, etc.�cost money.

Assistance and payment of fees associated with the alien registration process�these are the things you should be negotiating with your employer. They can't simply provide you with an ARC, but get as much out of them as you can to facilitate the process.

So the contract could state that your employer should provide you with assistance in obtaining your ARC, rather than the ARC itself, which Immigration could deny at their whim, like because you fail the medical or something. BTW, it is traditional that you should pay for the medical check yourself.
