I can only blame myself for my situation. I am writing this not as a rant or complaint, but more as a warning for others.

Like most others on an E-2 visa, my visa expired a few days before my contract was up. Since I was supposed to fly out within 5 days of the end of my visa, I decided not to extend my E-2 visa for that last week. There were many reasons, distance to immigration, no spare time, but probably more importantly, a laziness on my part. Also, at that time I wasn't planning on coming back to Korea.

Leaving the country wasn't too hard, just went to immigration at the airport and they made me fill out a form and I was off.

Fast forward 2 months. I came back to Korea on a tourist visa with no problem. I found a job, gave them all of my info, and they sent it off to immigration to get my visa number so I could go on a visa run to Japan.

Ah, not so simple. Since I was in Korea for 5 days without a visa, I had a red flag on my file. Since I had violated my visa, I was required to get an interview in my home country. The school was slightly understanding, and extended my start date. So now, here I sit, back in America waiting for my 5 minute interview.

Again, I am not writing this to complain about the new regulations in Korea, but merely to give a first hand account that THERE IS NO GRACE PERIOD FOR E-2 VISAS!!!! If you want to come back to Korea, or re-sign a current visa, GET A VISA EXTENSION!!!!!

Please, someone learn from my laziness.

Thanks -- I'm probably about to go through the same thing. Was your 5 minute interview different than the other, newly required 5 minute interview?

Bottomline: Don't be lazy.

Probably should make some kind of comment about your lack of decision making skills but a sudden bout of laziness has hit me ... go figure.

I'll never understand why something as simple as an interview can't be conducted at the local embassy especially if you're already in country.

Anyway thanks for the headsup.

Maybe because NO COUNTRY has one of its own embassies inside its own borders ergo: There IS NO "local" KOREAN embassy in Korea.

The rule is also pretty simple.

IF you have NOT had and E2 you need a consular interview in your home country.
IF you have a violation in your file you need a consular interview in your home country.

BOTTOM LINE:
There is no grace period. You have until midnight on the last date indicated on your ARC to leave the country or face the consequences.

Wrong wrong wrong. If you have not had an E2 before you do NOT have to return to your home country for an interview.

You're soooooo right. Immigration only gives E-2 visas in-country to those who are here illegally or on tourist visas.

And for those of you that are math-minded:

(previous E-2 = yes) + (immi problems = no) = no home interview

(previous E-2 = no) = home interview

(previous E-2 = yes) + (immi problems = yes) = home interview

Well, my pooper says that those that come here on a tourist visa (NOT an E-2) don't get an E-2 without going home for an interview. That's why newbs are getting the interviews done these days. I'm sure waiting at the Korean Consulate (which may are may not be hours away from home) is loads of fun, but if people didn't have to do the interview I'd imagine they'd just jump on over and do it your way.

My all-knowing arse also says that there have been endless posts about the third-country rule for getting E-2s, and it applies to those that have had a previous E-2 for a certain amount of time (although according to newspapers, that time limit may be shortened by a healthy amount).

The behind has spoken. Excuse the bad breath.

Ok man don't believe me. You seem to know it all. No E2 before do not have to go home for an interview. Find me one poster on this forum who had to go home for an interview.

You only need to get your degree verified and then you are off to Japan.

What about the OP in this thread.

Liveinseoul, under the new E-2 visa laws, jackson7 is correct, so is ttompatz. It's not as simple as last year, or your comments would be correct.

If you are currently in Korea and need a new visa (changing jobs, gaps b/t contracts, etc.), your new school takes your documents, degrees, etc. to the immigration office and you get a visa issuance number. At that time, immigration will tell you A. You must return to your home country, get the visa in person and have an interview (this would be for previous E-2 holders with some kind of violation on their record), or B: You may travel to 3rd country to get your new E-2 visa. This requires no interview. If you do travel to your home country, the Korean consulate will PROBABLY exempt you from the interview and let you get your visa through the mail. This is up to each Consulate.


If you don't believe this, dial 1345 and ask for yourself.
