|
|
I have problems understanding the terms & have received conflicting information. My current contract ends 8/25 and I will be working elsewhere right after that. I will not leave Korea.
Article 9
2. The written notification of renewal or termination of Employment shall be provided two months prior to the expiration of contract.
4. In the event Employee travels to his/her home country pursuant to the foregoing 2, Employee will be given a free round-trip ticket. In the event employee does not travel to his/her home country pursuant to the foregoing 2, Employee will be given the amount of money equivalent to the round trip airfare. (is that only if you renew)?
If you do not renew, will the school pay the equivalent of a 1 way return flight? Or do I have to do the ticket switcheroo?
Thanks |

Stop trying to look for ways to cheat the system - Your contract is quite clear, and neglecting to include relevent parts will only lead to somebody giving you false information (perhaps the information you want to hear).
You are on the 2007 contract, which I am sure is not much different from the 2008:
Article 9(Contract Completion)
1.The Term of Employment stated in Article 4 may be renewed by a mutual written agreement between Employer and Employee, provided that each renewed employment term is one(1) year.
2.In the case of renewal of this contract pursuant to the foregoing 1, Employee shall be given a two-week (weekends and holidays included) home leave which is extra, beyond the 14 days vacation. Home leave should be taken in the summer vacation just before or just after the contract year is up.
3.In the event Employee travels to his/her home country pursuant to the foregoing 2, Employee will be given a free round-trip ticket. The round-trip airfare for Employee’s flight shall be based on the rate provided for in 4 hereafter. In the event employee does not travel to his/her home country pursuant to the foregoing 2, Employee will be given the amount of money equivalent to the round-trip airfare to the different location(expense of this travel fare must be less then the fare of homeland visit) he or she may embark to during their home leave period or if member decides to stay in Korea during this period, the employee will be given the amount of money equivalent to the round-trip airfare to their homeland..
4.The round-trip airfare for Employee’s home leave shall be loaned by Employer based on an economy class air-fare(less than 75% of the regular price) of the most direct flight available from Incheon to the airport nearest to Employee’s residence.
5.If Employee completes the Term of Employment without the intention to renew and leaves Korea within 10 days from the expiration date, Employer shall pay for Employee’s one way return flight.
If the contract says "pursuant to the foregoing 2", it is ONLY talking about renewal vacation flights. As for quitting and getting a flight paid back home, section 5 i quite specific about this. The information in your contract is the same as I, and numerous others, have already given you on this board.
The 2008 contract, whilst worded slightly different for clarity, includes the exact same policy.
Article 9(Contract Completion)
1.The Term of Employment stated in Article 4 may be renewed by a mutual written agreement between Employer and Employee, provided that each renewed employment term is one(1) year.
2. The written notification of renewal or termination of Employment shall be provided two months (60 days) prior to the expiration of Contract.
3. In the case of renewal of this contract pursuant to the foregoing 1, Employee shall be given a fourteen day (14) (weekend and national holidays inclusive) additional home leave vacation period which is extra, beyond the 14 days’ yearly paid leave. Home leave must be taken during the vacation periods not conflicting with school schedules either just before or just after the contract year is completed
4. In the event renewing Employee travels to his/her home country, Employee will be reimbursed for his/her round-trip airfare based on economy class air-fare of the most direct flight available from Incheon to the airport nearest to Employee’s residence within 2 weeks upon return to Korea.
5. In the event renewing Employee travels to another country with a shorter distance than that of home country may be reimbursed for their round-trip airfare pursuant to the foregoing 4.
6. In the event Employee does not travel to either his/her home country or another country other than home pursuant to the foregoing 3, Employee will be given the amount of money equivalent to the round-trip airfare within 2 weeks upon renewal of Contract. Vacation is used in the manner pursuant to the foregoing 3.
7.If Employee completes the Term of Employment without the intention to renew and leaves Korea within 10 days from the expiration date, Employer shall provide the airfare for Employee’s one way return flight to the employee’s home country either in the form of reimbursement or direct purchase. |

Stop trying to assume & talk out of your ass. I typed the articles as specified in my contract. The wording is exact and not the same one that you typed. I did not neglect to include any relevant parts.
Don't post if you are going assume/accuse me of something you don't know jack shit about. |

YOu ahve only included articles 2 and 4. Include all articles, and I bet my left nut they have a specific clause related to the return airfare if you do not sign a new contract. |

Yep... I was right. This is from the 2007 contract, and it seems you convenently left out articles 1 and 3. It is not much of a surprise to find that these specifically mention that they are only talking about renewals.
What you going to do? Tippex them out of your contract and try your luck with labour? Perhaps Labour will side with you if you say "Dave's said so!"
2@!
