I apologize for my ignorance on this. Just completed my first contract in Korea. Just learned my Hawgwon Did not / was not paying into my Pension plan. Nor did I make any contribution on my cheque.

I received a printed statement monthly. No bank statement.

My question is............IS THIS LEGAL? Does my school in fact owe me this money which amounts to $1,242,000 WON 4.5% of my annual salary.

Right now I should be going to wherever it is I am supposed to go and get back about $2,400,000 WON in pension but instead I have

ZILCH.

What should I do?
What can I do legally?
Is my school supposed to pay this?

Your school broke the law. Your school is supposed to pay into it.

What can I do legally?

You can go to the pension office, file a formal complaint, pay YOUR portion of the premiums into your pension plan and they will go after your old boss for the balance.

You may have to work at it because often the clerk at the desk, while friendly enough, is too lazy to get involved in fighting for you.

The same thing is happening to me. I'm still working for my employer, but I went to the NPO two months ago and they said he wasn't paying into it. I'm going to confront him in August, when my contract is almost up, so if he fires me it's no big fuss. I would file the complaint, atleast get the ball rolling. Maybe if you threaten the almight Labor board trick, he will give in?
