Hello All,
I am taking my Korean wife to the US for a vacation and want to know what that immigration form is that I need to fill out for her as soon as we arrive at the immigration checkpoint just after getting off the plane. Last time the stewardess gave us bad info and we gave them the wrong papers. It is something else besides the cards that they give you on the plane. It is important because last time we had to go to the back of the line and almost missed our connecting flight. Anyone know what the form is? Any help is appreciated.

the forms you fill out are visa dependent.... what visa is she traveling on? |

At the port of entry, an Immigration official must authorize the traveler's admission to the U.S. At that time the Form I-94, "Record of Arrival-Departure," which notes the length of stay permitted, is stamped.
The problem arises because of the marriage and the fact that they may want assurances that you are not using the non-immigrant visa to get around the wait times for immigrant visas.
You may want to read through this, or as an alternative, plan extra time between flights for the extra paperwork and summary adjudication of her entry.

Thanks for the link ttompatz. We are only going there on vacation, it is just a quick 3 week visit. We will return to Korea.
I know that I have to apply for the I-130. The last time I was at the embassy, the guy wasn't too happy about it and only gave her a 1 year NIV, that's why I have to go there again. Don't most people get 5 or 10 years? But, the form I need is the I-94 to get her through immigration?
Sorry for all my questions, I just want to avoid that situation again.

the 5 or 10 year NIV are for people who are NOT eligible for K1/3 or CR 1/3 status.
Like I said, they are more concerned with your using the NIV to get around the wait times for the immigrant visa and jump the line.
Also, your wife is entitled to immigrant status if/when you do decide to move home so they don't like to give the NIV when she is entitled to residence.

Thank you for your help. I understand why they do it, but we are only going on vacation. I guess they have to assume that EVERYONE is trying to jump the line? You are always helpful, thanks again... |
