A WARNING to teachers who have overstayed their E-2 visa in the past:

According to the new visa regulations, any teacher who has overstayed their E-2 visa in the past and wants to teach in Korea again MUST go for an interview in their home country AND obtain their visa in their home country. No exceptions.

People who have overstayed their past visas can never do quick visa-runs to Japan ever again. They must ALWAYS apply in their home country (AND go for an interview in their home country) every time they wish to obtain a new E-2 visa to work in Korea again.

Hope this message saves some people from a big headache... it's not highlighted in the new visa regulations anywhere at the moment.

Sounds like bollocks to me.

Needs a source, just not from the horses mouth.

If true, then Korea is becoming even more backwards in its English education pursuits.

And also, seems like another tedious hoop to have thousands of past and current teachers calling immigration asking: "Um, excuse me, have I overstayed in the past and you guys are a bunch of morons."

maybe the OP just heard a rumor or something, lord knows there's been 1000 of those regarding visas

that said, if you broke the law before, you SHOULD have some penalties.. If people were in my country illegally, I'd want them out and never to return.

He is correct. I have a teacher on a plane back to Canada this weekend because he overstayed his last visa by 1 day. We have tried every way around it possible. If you have a black mark on your visa, for any reason, you must return to your home country for a visa interview.

It must be part of last years visa law changes. To teachers who started contracts prior to the new laws and have not yet completed them, this would be news to them.

Can you imagine the numbers of teachers who now need to call their respective immigration offices to ask about any black marks on their visas. Sounds like a headache for both parties involved.

I guess it's news to those who have had their head in the sand since March... but if one breaks the law there's usually consequences.

Isn't it fairly stupid to fly back home then fly back here. I mean the airfare is really expensive to it's superfluous to fly all over the planet for a piece of paper.

Korea goes out of its way to punish people whose only crime is choosing to work here.

Sparkling.

Korea isn't going out of its way to punish anyone.

Further, no one is being punished for choosing to work here. They are being "punished" for violating immigration laws.

When you enter a foreign country, it is YOUR responsibility to make yourself aware of the regulations governing your status of stay and to abide by them. That includes being aware of your permitted dates of stay and obtaining an extension or departing before that period expires. Ignorance of the law is no excuse.

I wouldn't even consider the interview requirement a punishment. An inconvenience, certainly, but a punishment? Punishment would be denying all future E-2 visas to previous violators, or banning them for a period of time.

What if 8 years ago when renewing your contract the secretary of the English Department is the one who fills out the forms for a renewel and takes it to the immigration office and made a mistake for the date and your Visa expired during final exam week.

I was a teacher once, and overstayed my visa while not on an E2 visa. Would this still apply for me if I want to teach again?

They would be wasting my time if they want to still interview me.

Erm, and our own countries don't punish people violating immigration laws when their only crime is to work in that country? [/quote]

HIJACK ALERT:

What if the offender in question is simply renewing at his or her current school?

You carry the ARC, right? Not the English department secretary, right?

It's YOUR responsibility to be aware of the dates printed on your ARC.

It's YOUR responsibility to make the appropriate arrangements for an extension if your permitted period of stay expires before your contract ends.

You're an adult. You're living in a foreign country. If you can't handle the responsibilities that entails, go home.
