FIRST YEAR EMPLOYMENT AGREEMENT FOR HANSOL INSTRUCTOR


This EMPLOYMENT AGREEMENT (Hereinafter referred to as �contract�) has been made this
by and between Brighton Junior English School having its office at South Korea (Hereinafter referred to as "employer"); and _____________________ a citizen of whose address is (Hereinafter referred to as "employee").



Employer and employee agree as follows;


Employee accepts employment from employer to teach the English language under the terms and condition set forth here in the agreement for a period of twelve full and consecutive teaching sessions. Employment commences from the first day of orientation and finishes on the last teaching day of the last teaching session (twelfth teaching session) covered under this agreement.
The visa period;
(Including Orientation period, will be extended for the contract period.)
The contract period ;
The last teaching day of the lasting teaching session.

1.supervision
1-1 The teacher will work closely with the Academic supervisor and other colleagues in the planning observation, and review of instruction.
2-1 The teacher should respect the director and supervisor�s orders, related the class.

2. Duties

2.1 During the term of this agreement, the employee is required to prepare for, teach, and carry out all required administrative duties connected with classes assigned by the employer. The minimum teaching requirement is 120 teaching hours (1 session = 20 teaching days). Monday through Friday are teaching days except for scheduled public holidays and vacation days.
Required administrative duties connected with classes.
a. Instruction in and all phases of the Institute�s program to classes that range from the Preschool to adults.
b. Out of classroom activities for /with students.
c. Grading and evaluation of students.(progress report)
d. Students counseling or evaluation.
e. Phone teaching for students.
f. Attendance at teacher�s meetings, workshops, school events, presentation.(open class as public relation)
g. Other related activities.
-Articles from c to g are compulsory & not considered class hours.

2.2 Payment made for assigned teaching classes is inclusive of payment for preparation,
presentation, and administrative duties (such as phone testing, writing students card& maintaining neat arrangement of classroom & faculty room) connected with those assigned classes. Employee agrees to attend meeting, school events & workshops scheduled by employer.
If employee works on Saturday for the students enrollment as public relation, it will be paid (20,000 won per hour, normally 8 times per year)

2.3 The employer will have the authority to require employee to perform teaching duties in excess of the minimum teaching requirement, such excess being no more than 20 hours per session. Total classes taught in excess of the minimum requirement are calculated on a monthly basis. Payment is made at the rate of 4,500 Won / 10 min

2.4 Working hours are normally 10am-7pm. However, working schedule may vary according to school field trips, school presentations, workshops, etc. No regular schedule of working hours can be guaranteed to employee.
Payment made for assigned classes is inclusive of payment for preparation and administrative duties connected with those assigned classes. Employee agrees to attend meetings and training workshops scheduled by employer. The purpose of meetings and workshops is to inform employee of matters relating to employee's duties and the institute's operation, or to assist in employee's professional development. No payment in excess of or in addition to employee's monthly salary will be made for attending meetings or workshops scheduled by employer.


2.5 Employee may teach classes in other locations such as colleges or other institutions which are scheduled by employer. In that case, employer will pay extra transportation fees other than the regular route. Employee will be paid by actual teaching classes.


2.6 Should be prepared for the first lesson before 30 minutes from Monday to Friday.
Working hours are 9;30-6;30 or 10;30 -7;30 PM but employee�s an average of teaching class will be for 6 hours, such average being calculated over each month.

2.7 At all times during the term of this agreement, employee will directly adhere to and obey all the rules and regulations that have been, or may hereafter be established, by employer for the conduct of employee or generally for the conduct of instructors at the place of employment.
In the event that employee disobeys the rules or neglects his/her duties over 3times employees
Will not guarantee severance payment.

2.8 When employee misses a class for personal reason, 18,000 Won per class(= 40min, at the rate of 4,500won/10min ) missed will be deducted from salary.

2.9 Employee should take responsibilities of the student�s safety in employee�s classes.


3. Compensation


3.1 Salary:

Except for the period of orientation and training, employer will pay employee for the minimum teaching requirement the amount of 2,200,000 Won for each session of this agreement. Payment for extra teaching class is made at the rate of 4,500Won / 10min. Total gross monthly earnings for the minimum teaching requirement is 2,200,000Won/session. Teaching salary will commence from the first day of teaching. Korean income taxes and Korean National Pension Scheme deductions will be withheld (currently 3~5%). Monthly salary payments will be during which the employment services were provided.(The salary for March will be paid on April 14th)

3.2 Orientation and Training: Shortly after arrival in Korea, employee will be required to undertake orientation and training before commencing teaching. Transportation & lunch are provided, the period of training and orientation will be usually one week but employer reserves
the right to reduce period in case where employee arrives in Korea less than one week before
commencement of scheduled teaching session or increase period(less than 2weeks)

3.3 Severance Payment: Dependent upon completion of at least one full year (twelve sessions) of employment with employer, employee will be given, exclusive of monthly salary payments, an additional 1/12(one twelfth) of one month�s total earnings for each month of employment since commencement of employment with employer. Korean severance tax will be withheld. This payment is given on the 16th day after the last pay day.

3.4 Re-signing Bonus: In the event that employee completes the contract of his or her obligation after which both employer and employee agree to continue a second year contract,
the employer will pay employee a bonus of 400,000 Won at the commencement of the second year contract.


4.Transportation


4.1 Transportation: Employer will provide for employee an economy class ticket for passage to Korea from an international airport which is mutually agreed to by employer and employee (henceforth referred to as point of departure). On completion of the full contract period, employer will provide for the employee an economy class ticket for passage from Korea to point of departure. The return air ticket will be provided at the time of termination of employment. In the event that the employee continues employment under a subsequent employment agreement with employer; the return air ticket will be provided at the time of completion of the subsequent contract period(s). Air tickets provided cannot be exchanged for cash equivalents or transferred to persons other than the employee. Employer does not agree to, and is not liable for, compensation to employee, whether in cash or otherwise, for air tickets which are not used by employee.

4.2 Relocation Allowance : Employer will pay 250,000won to employee on the first of the orientation period.


5. Housing


5.1 Employer will provide none shared studio apartment furnished living accommodations for employee. Accommodations shall be equipped with chairs, a gas burner, a refrigerator, a telephone, a television, and a washing machine. Furnishings provided to each employee include : A bed, a wardrobe and dining table.

5.2 The cost of monthly services, utilities and telephone charges for accommodation provided by employer will be shared by the employees sharing an accommodation. During any period of sole occupancy employee will be responsible for the cost of all monthly services, including management fee, utilities and telephone charges.

5.3 Employee agrees to pay 200,000Won during the first two months of employment as housing management deposit. It is deducted in the amount of 100,000Won/month for the first two months. This deposit is to cover unpaid monthly service, utility and telephone charges. Dependent on a written guarantee from a guarantor acceptable to employer, employer agrees that the deposit will be returned, in full, to the employee at the time of completion of employee�s period of employment with employer, including any class of employment beyond that covered by this agreement. In the absence of such written guarantee, employer will hold the full amount of the deposit until all outstanding monthly service, utility, and telephone charges have been paid. In the event that employer makes payments covering monthly service, utility, and telephone charges on half of employee, the amount of such payments will be deducted from the deposit and the remainder of the deposit returned to employee. Employer agrees that payment of remaining amounts of the deposit will be made to employee within ten days after all outstanding monthly service, utility, and telephone charges have been paid.

5.4 There is no other facility except the things on the contract. The extra things employee may need later are considered as expendable ones and it has to be paid by employee.
All the equipments that employee buy have to be terminated by employee�s expense when the contract is completed. (such as internet & cable TV connection)

5.5 Employee has to maintain the living accommodations clean for the next residents.


6. Holidays and Vacation


6.1 Employee will be entitled to observe public holidays and receive vacation days during the contract term according to the yearly schedule provided by employer before the commencement of the year to which the schedule refers. There are at least seven (10) vacation days and national holidays in each calendar year ( January � December ).

6.2 Absence from Duties: Salary is not maintained when employee is absent from teaching duties.

6.3 Emergency Leave: Employee will be eligible to receive up to three(3) days of paid emergency leave in the event of death or serious illness in employee's immediate family,
only when all necessary documents are provided.
Such emergency leave will be granted at the sole discretion of employer.
If parents of employee pass away , Employee is eligible for seven.(7) days , including weekend, paid of emergency leave.

6.4 When sick or having an illness, you must visit a doctor immediately, and present a doctor�s note to the supervisor before receiving time off from your regular schedule/duties.

7. Medical Insurance


: Employee will be covered by medical benefits under the Korean Medical Insurance Union, a Government Health Organization. The costs of this coverage will be borne half by employer and half by employee. Payment will be made by monthly deduction from employee's salary.


8. Accident Compensation


: In the event that employee sustains injuries from an accident or mishap which occurs outside the course of normal work duties; employee understands and agrees that employer will have no responsibility for, nor obligation to pay, medical and hospital costs which are in excess of those covered by medical insurance.


9. Dismissals or Voluntary Resignation


9.1 Employer will have the right to dismiss employee for unwillingness or inability to meet conditions of employment as set out under this agreement, for conduct seriously jeopardizing any student or staff person, or for criminal activity.

9.2 In the event that the employee is dismissed, or in the event that the employee voluntarily resigns prior to the termination of the term or this agreement, employer will pay salary due up to the date of termination. Employer will not pay the cost of return transportation to point of departure for employee, nor will employer pay any severance payment. Further, employer will be entitled to withhold an amount less than or equivalent to, but not exceeding, the cost of relocation allowance given on arrival in Korea if the teacher does not complete the twelve-month contract. The cost of air fare provided for travel to Korea must be paid back to the school if the teacher is to leave the school prior to 6 months of work in case of voluntary resignation, employee must announce his/her resignation to employer before 2 months.)
Employee should complete employee�s duty under terms and condition attached until new employee will be hired. ( less than 2 months).

9.3 In the case employee breaks the working code or covenants, employer can dismiss employee.


10. Covenants


10.1 Employee hereby agrees, covenants, and undertakes that he/she will not undertake any teaching duties or employment with any persons or organizations other than the employer.
To undertake such employment is a breach of Korean Immigration law and can have serious consequences.
10.2 The employee understands and accepts that the rights to use, sale, distribution, or publication of all original material produced by the employee during the course of employee's employment, and for which the employee is compensated as either regular pay, as overtime, or in an agreed-upon lump sum, remain the sole property of employer.


11. Jurisdiction


: This agreement will be interpreted according to the internal (domestic) laws of the Republic of Korea. A competent court in the Republic of Korea will have jurisdiction in regard to any dispute or claim arising out of, or in connection with, this agreement.


12. Others


12.1 This contract states only basic regulations of working conditions and each clause should be recognized as a general rule. Thus, employee should follow the conditions of all items according to the attached regulations. The attached regulations may vary according to each situation.

12.2 While working at school, employee should behave according to Korean courtesy and culture and should try to maintain an open and positive attitude.
Employer and employee have executed this agreement on the date indicated below.
Intending to be legally bound to, and in witness of, employer and employee have appended their signatures.

2-1 The teacher should respect the director and supervisor�s orders, related the class.

Aboslultely priceless, I pretty much stop reading the contract after that. Is there a section that says "director and supervisor should respect the teacher's rights?"

Just read the entire section 2 of the contract, it is absolutely horrible and NEVER SIGN IT!!!! I am only about 25% through the contract and I know this school would be horrible. Seriously, is this contarct a joke?

edit 2nd time:

I have now finished about half of the contract, but honestly I don't have the time right now to tear this contract apart, it is absolutely horrible. Please tell me that you will never sign it.

This is the third contract that I have been offered. I didn't want to take the first thing offered, yet each one has been worse than the last. The second one read Iksan Public School Contract at the top and then on page 3, there was mention of The Wonderland School. I pointed this out to the recruiter and never heard back.

Have you been using the same recruiter the entire time? Is so, then use a different recruiter. There are lots of them and they all have different contacts.

If you have been using different recruiters then just be patient. A far better contract will come soon.

Also, I have pretty much read the entire contract, NEVER SIGN IT!!!! There are so many problems in this contracts that it is not even funny.

Total classes taught in excess of the minimum requirement are calculated on a monthly basis. Payment is made at the rate of 4,500 Won / 10 min meaning they'll hold the teacher to exactly 120hours/month and not calculate breaks into the teaching hour

2.5 Employee may teach classes in other locations such as colleges or other institutions approved by immi? which are scheduled by employer. In that case, employer will pay extra transportation fees other than the regular route. Employee will be paid by actual teaching classes.

2.6 Should be prepared for the first lesson before 30 minutes from Monday to Friday.
Working hours are 9;30-6;30 or 10;30 -7;30 PM but employee�s an average of teaching class will be for 6 hours, such average being calculated over each month. 6 hours average calculated over a month. nice! I can see some long days in there

I was looking for work and Brighton English School contacted me whilst I was in Korea. I went along to visit the school and chat to the teachers but the one thing that I noticed was that the teachers were really busy for hours on end. They were constantly in a classroom and having to supervise 3 year olds.

One other thing that really annoyed me was the fact that they would deduct money for my first three months as a security deposit for the apartment. I told them that I would get my own apartment with my own deposit but they said that they would still deduct the money from my salary. I mentioned that it was illegal to deduct money from a salary just because. I passed my wife to them and she gave them hell and got that removed from the contract.

When it came to lunch time, the teachers had to eat lunch with the students so your time for a break isn't really your own. I had to negotiate with the contract with the school and then the breaking point came. I asked whether I could book my own holidays when I want but they mentioned that holidays are allocated and you take a holiday when they want you to. It was real bad and the school is pretty nice in Ilsan but the management expect their teachers to be slaves.

I told them to f*ck themselves and if they want a qualified teacher, they should pay up a decent salary, offer a family man decent holiday time as well as allow me to have my lunch in peace and not spoon feed 3 year olds.

Sign the contract if you want to be a slave to the Korean management, otherwise walk away 'cos there are better schools to be had. It really is a laugh how they are still in business, their business practices are questionable and they treat the teachers really badly.

Thanks for the info on the Brighton School and don't worry, I wont be signing the contract. The recruiter now wants me to consider another school in Seoul and I've got one school that I'm in direct contact with. My friends brother has subbed there and says that the owner is a very nice man. Time will tell.

When I was looking for a job I looked at and turned down about 50 jobs after looking at the contracts and extra research. Used numerous recruiters but maintained a very polite persona with them, thanking them very much but no thanks. After all that, I was offered an EPIK contract and after research took it. Very very happy with my decision.

Don't get rushed into it. Take your time. A year can be a very long time in a sh*tty school.

Bend over please, I would like to place a hard object up your back passage.

Don�t forget that the scheduled public holidays and vacation days are scheduled by Korean management and are expecting you to work when they want. Additionally, 120 hours teaching is not really broken down (weekly, monthly, annually, what???). What times are you required to be at the school, what time do you finish?

Required administrative duties connected with classes.
a. Instruction in and all phases of the Institute�s program to classes that range from the Preschool to adults.

Ahh, they are introducing adults to the school, that should work with the small furniture they have for the kids. Korea joking!!!

How much grading and evaluation is required? Is it per month, week or day? The devil is in the detail.

Wow, a real slave would agree to that. I would tell them to forget it. 120 hours per month I think plus all those other duties that you are required to do will burn you out in 3 months.

Is this voluntary. I guess not.

Overtime is voluntary and this statement is illegal, I would tell the to delete this and get it rewritten if they want to employ you.

My god, 10am to 7pm that is a real long day. Move on, now I can see how your day is going to be. Trust me 3 months of employment and you would be wanting to run.

This is totally illegal for E2 Visa holders and must have approval from immigration. Get this deleted. Again overtime and extra teaching is voluntary.

6 hours of teaching in a day and the rest will include other mundane duties such as feeding kids, etc.

2.7 At all times during the term of this agreement, employee will directly adhere to and obey all the rules and regulations that have been, or may hereafter be established, (requires agreement by you and your employer and not just accepted by managers so that they can get you to do anything they want) by employer for the conduct of employee or generally for the conduct of instructors at the place of employment.


In the event that employee disobeys the rules or neglects his/her duties over 3times employees
Will not guarantee severance payment.

That is totally illegal. Drop that from the contract. Why are they so worried that you won�t obey their rules? �Cos they have a load of runners each year that�s why.

14 days after the month is too long to pay teachers, 10 days is acceptable. Get that changed otherwise switch to another school.

Severance is calculated by adding the last 3 months salary and dividing it by 3 to get the average salary per month. What they provide as severance is illegal. Also what is the Korean severance tax rate? 10%? 30%? I wouldn�t be surprised if they don�t tell you. So they get paid your last month 14 days late and then they hold on to your severance for 16 days? That is a full 30 days before you see the severance. Totally illegal. Get that sorted out if you want to have a painless experience in Korea. Just totally flawed.

3.4 Re-signing Bonus: In the event that employee completes the contract of his or her obligation after which both employer and employee agree to continue a second year contract,
the employer will pay employee a bonus of 400,000 Won at the commencement of the second year contract.

I got paid 1 million won resigning bonus. They are cheap.


4.Transportation


4.1 Transportation: Employer will provide for employee an economy class ticket for passage to Korea from an international airport which is mutually agreed to by employer and employee (henceforth referred to as point of departure). On completion of the full contract period, employer will provide for the employee an economy class ticket for passage from Korea to point of departure. The return air ticket will be provided at the time of termination of employment. In the event that the employee continues employment under a subsequent employment agreement with employer; the return air ticket will be provided at the time of completion of the subsequent contract period(s).

So if you re-sign, they won�t let you have your return airfare and will hold on to it for 2 years. Totally wrong.

Air tickets provided cannot be exchanged for cash equivalents or transferred to persons other than the employee. Employer does not agree to, and is not liable for, compensation to employee, whether in cash or otherwise, for air tickets which are not used by employee.

4.2 Relocation Allowance : Employer will pay 250,000won to employee on the first of the orientation period.


5. Housing


5.1 Employer will provide none shared studio apartment furnished living accommodations for employee. Accommodations shall be equipped with chairs, a gas burner, a refrigerator, a telephone, a television, and a washing machine. Furnishings provided to each employee include : A bed, a wardrobe and dining table.

5.2 The cost of monthly services, utilities and telephone charges for accommodation provided by employer will be shared by the employees sharing an accommodation. During any period of sole occupancy employee will be responsible for the cost of all monthly services, including management fee, utilities and telephone charges.

If the employee is responsible for everything including cost, why does the school have to take 400,000 KRW from your paycheck? Doesn�t make sense unless the Korean management what to pay for their next double barber pole visit after you start work to celebrate such a wonderful slave they have just employed.

5.3 Employee agrees to pay 200,000Won during the first two months of employment as housing management deposit. It is deducted in the amount of 100,000Won/month for the first two months. This deposit is to cover unpaid monthly service, utility and telephone charges. Dependent on a written guarantee from a guarantor acceptable to employer, employer agrees that the deposit will be returned, in full, to the employee at the time of completion of employee�s period of employment with employer, including any class of employment beyond that covered by this agreement. In the absence of such written guarantee, employer will hold the full amount of the deposit until all outstanding monthly service, utility, and telephone charges have been paid. In the event that employer makes payments covering monthly service, utility, and telephone charges on half of employee, the amount of such payments will be deducted from the deposit and the remainder of the deposit returned to employee. Employer agrees that payment of remaining amounts of the deposit will be made to employee within ten days after all outstanding monthly service, utility, and telephone charges have been paid.

Here we go, the illegal deposit withdrawn from your salary, get that out your contract. You will have a hard time getting that deposit back. I wouldn�t be surprised if the severance tax is around 400,000 KRW. How convenient.

5.4 There is no other facility except the things on the contract. The extra things employee may need later are considered as expendable ones and it has to be paid by employee.
All the equipments that employee buy have to be terminated by employee�s expense when the contract is completed. (such as internet & cable TV connection)

5.5 Employee has to maintain the living accommodations clean for the next residents.


6. Holidays and Vacation


6.1 Employee will be entitled to observe public holidays and receive vacation days during the contract term according to the yearly schedule provided by employer before the commencement of the year to which the schedule refers. There are at least seven (10) vacation days and national holidays in each calendar year ( January � December ).

Am I reading this right? Seven (10)???? What the feck? You are entitled to a day off each month. That is 12 days per year. You can use the holidays how you want and I believe national holidays equal to about 14 days per year. You can have around 26 days off per year including national holidays. Good luck trying to get this changed. It looks like a kid has wrote that.

6.2 Absence from Duties: Salary is not maintained when employee is absent from teaching duties.

6.3 Emergency Leave: Employee will be eligible to receive up to three(3) days of paid emergency leave in the event of death or serious illness in employee's immediate family,
only when all necessary documents are provided.
Such emergency leave will be granted at the sole discretion of employer.
If parents of employee pass away , Employee is eligible for seven.(7) days , including weekend, paid of emergency leave.

6.4 When sick or having an illness, you must visit a doctor immediately, and present a doctor�s note to the supervisor before receiving time off from your regular schedule/duties.

Please sir, can I go to the toilet? Please sir, can I be sick? Please sir, go F**K YOURSELF!!!

7. Medical Insurance


: Employee will be covered by medical benefits under the Korean Medical Insurance Union, a Government Health Organization. The costs of this coverage will be borne half by employer and half by employee. Payment will be made by monthly deduction from employee's salary.

I thought it was called the National Health Corporation. Looks like the school is getting out of paying insurance for you.


8. Accident Compensation


: In the event that employee sustains injuries from an accident or mishap which occurs outside the course of normal work duties; employee understands and agrees that employer will have no responsibility for, nor obligation to pay, medical and hospital costs which are in excess of those covered by medical insurance.

Yep, definitely private health insurance. Get that changed now!!!

9. Dismissals or Voluntary Resignation


9.1 Employer will have the right to dismiss employee for unwillingness or inability to meet conditions of employment as set out under this agreement, for conduct seriously jeopardizing any student or staff person, or for criminal activity.

Hmm, criminal activity. The employer is involved in more criminal activity than the teacher.

9.2 In the event that the employee is dismissed, or in the event that the employee voluntarily resigns prior to the termination of the term or this agreement, employer will pay salary due up to the date of termination. Employer will not pay the cost of return transportation to point of departure for employee, nor will employer pay any severance payment. Further, employer will be entitled to withhold an amount less than or equivalent to, but not exceeding, the cost of relocation allowance given on arrival in Korea if the teacher does not complete the twelve-month contract. The cost of air fare provided for travel to Korea must be paid back to the school if the teacher is to leave the school prior to 6 months of work in case of voluntary resignation, employee must announce his/her resignation to employer before 2 months.)
Employee should complete employee�s duty under terms and condition attached until new employee will be hired. ( less than 2 months).

You are allowed to provide 30 days resignation to the company get it changed to 30 days.

9.3 In the case employee breaks the working code or covenants, employer can dismiss employee.

What the working code? Is this legal?

10. Covenants


10.1 Employee hereby agrees, covenants, and undertakes that he/she will not undertake any teaching duties or employment with any persons or organizations other than the employer.

Ya a slave boy!!!!

To undertake such employment is a breach of Korean Immigration law and can have serious consequences.

Ahh, yes, immigration law, let�s not forget the breach of immigration law you would encounter by teaching at other schools, etc.

10.2 The employee understands and accepts that the rights to use, sale, distribution, or publication of all original material produced by the employee during the course of employee's employment, and for which the employee is compensated as either regular pay, as overtime, or in an agreed-upon lump sum, remain the sole property of employer.

Anything you make, use or create at the school is the school�s. Remember the teacher is a slave.


11. Jurisdiction


: This agreement will be interpreted according to the internal (domestic) laws of the Republic of Korea. A competent court in the Republic of Korea will have jurisdiction in regard to any dispute or claim arising out of, or in connection with, this agreement.

This contract isn�t even legal, I would love to see how this would hold up in a court of law.

12. Others


12.1 This contract states only basic regulations of working conditions and each clause should be recognized as a general rule. Thus, employee should follow the conditions of all items according to the attached regulations. The attached regulations may vary according to each situation.

12.2 While working at school, employee should behave according to Korean courtesy and culture and should try to maintain an open and positive attitude.

Gotta love Korean culture. Remember Nike was at fault �cos they didn�t understand that the Korean Government like to point and joke about a naked female statue that was at Nike HQ. You must also remember that all foreigners are slaves and you must obey at all times.

So lets recap. Not sure I saw any mention about pension (otherwise it is really small in detail). No a lot of holidays per year. Illegal deposit withdrawn from your salary. 2.2 million KRW per month for 120 hours whatever a month is totally low. Get a public school gig. It is less stress and you won't have to worry about the crap from this school.

With regards to the KMIU health insurance. I checked out another thread and this is what Ttompatz had to say about it:
