A debt is a contract, and a contract needs consideration and communication. Telling a person after the fact that they owe more because they didn't pay on time is not a contact.

The type of collecting that I was talking about wasn't exactly legal. But, my point was that since it is my country and I naturally know many more people there are many, many more options available to me. And note I said 'available'.
When you step on peoples toes in your own country you know that many people have both above board and below ground connections that can bite you in the ass.People might argue that it's never a consideration but I doubt it. A girl with a hardass father and 4 older brothers would probably have a much lesser chance of being harassed, over a lone female child who is being reared by a single mother. And I'd argue that it's got little to do with the police or the courts or what have you.
Foreigners here are really at the bottom of the pecking order, legally and otherwise. Most of us don't have family near and some Koreans, if they are inclined to shady practices or intimidation don't need to worry that they're going to have both their legs broken in retribution.
And I like the example you gave with Revenue Canada and your employee.That's why I generally just try to keep my head down and go about my business. But I want the knowlege if and/or when I might need it.

Seems to me that you've led a sheltered life. My life was like a movie before I settled down with a wife a kids. And I write about what I know, the PI business being one of them.

While Mr. Gord was wrong about Canada's vacation laws, I doubt that was the point he was trying to make (correct me if I'm in error, Gord.) The main thrust of his argument seemed to be that if one pushs too hard, one stands to lose more than one stands to gain. This is a very valid point, and moreso as we are in South Korea, and not our home country. We as foreigners have less "rights" than the locals. Resorting to legal tactics will leave you at a disadvantage and resorting to illegal tactics might get you in even hotter water. Remember the other party can resort to said illegal tactics as well. Sometimes you have to know when to cut your losses and walk away.
Oh yes, BTW hell has now officially frozen over.  |

reading through some of the initial posters thoughts.. and the ones to follow, there seems to be a trend. I'm not saying that Gords approach was the best one... but Goshiwon guy seems headed for trouble. ALOT of people have had "interesting" lives, IF you feel the need to drag along your previous styles and apply them to Korea or other parts of the world, then I fear your doomed to stay in that rut you were in.
Honestly man, I think a thread similar to this IS needed... but from the sounds of your posts... you have other problems.

| Talk about the biggest load of $hit I have ever read. Here was a guy who was trying to give information to help people. Gord you are arrogant and it would not surprise me if you have been knocked out a few times with that attitude. Come on people we are all foreigners here and there are people getting screwed all the time. Why aren't people creative and helpful? We need moderators in here that can display these attributes and some useful knowledge, not attitude. If any of you think you are so much better than some of us others, you might want to take another look at yourself. To the OP good job for starting this. It eventually served the purpose of getting us all informed on exactly how things go here. In my opinion however, I would be extremely cautious when pi$$ing an academy off. |

I can't argue for or against the above statement since I don't know what its frame of reference is. But it appears that the Labor Relations Act and its Enforcement Decree provide for three different kinds of regular, paid time off from work (my use of the term "regular" excludes maternity and sick leave, etc.):
(1) paid holiday, which occurs on a weekly basis;
(2) paid monthly leave, which occurs as the name implies; and
(3) paid annual leave, which occurs as the name implies.
According to the Article 54 of the Act as it appears on the Ministry of Labor's website, employers are required to "allow a worker more than one-day holiday with pay per week on the average." The sense of the English word "holiday" varies with locale. I think here the term is used in the self-evident sense of weekly time off that we normally associate with weekends. The Act's language seems to mean that employers are required to give employees a day off per week plus some additional increment. No mention is made of how many hours an employee is required to work during the week to earn such an "average-of-one-day-plus-some" holiday. However, Article 25 of the Enforcement Decree of the Labor Standards Act requires "perfect attendance of contractual working days during a period of one week," implying that a work week is whatever the contract says it is.
But assuming only for the sake of argument that such a holiday depends on some legal definition of a work week, Article 57 of the Act provides for another kind of time off, namely "one day's leave with pay per month," to be "used by a worker, of his own free will, either by accumulating or dividing it within one year." Similarly to the paid holiday mentioned above, the paid monthly leave is granted upon "perfect attendance of contractual working hours during a period of one month," according to Article 27 of the Enforcement Decree.
And finally, Article 59 of the Act requires the employer to grant "10 days' leave[] with pay" to an employee who has "offered work without an absence throughout a year," and eight days' paid leave "to those who have registered more than 90 percent of attendance during one year."
The above was taken from the Ministry of Labor's English translation of the Labor Standards Act and the Enforcement Decree of the Labor Standards Act, which can be accessed by going to http://www.molab.go.kr:8787/English/index.jsp , clicking the topic "LAW AND REGULATION" near the top of the page, and clicking the titles of the two pertinent laws. These are, of course, translations, a fact which somewhat erodes certainty as to their reliability. And as with most laws, "You don't know what you don't know"; i.e., recent amendments, court cases, the intent of the legislature (often found in relatively obscure documents), the peculiarities and customs of the subject being governed or regulated, other laws, regulations, and who-knows-what-else can affect the meaning of the law. And very importantly, the realities of litigation can affect its ultimate meaning.

My 'previous styles' are my personal styles and not something that I adopt or discard like a trend. My way of doing things have brought me both prosperity and a degree of ruin, and I'm not about to change them for that very reason. Namely, I always go back up. And my reference to having led an interesting life was specifically for the poster who tried to make me out to be some sort of flake, living out a b-grade fantasy.
And I don't look for trouble but turning the other cheek all the time is just a cop-out. If you don't look out for yourself, who will do it for you? And who will you ever be able to look out for if your only experience with adversity is to meekly distance yourslelf from it.
All I asked for was for people to pool ideas on how to get what you are owed. I don't advocate ripping anyone off.
Out of all of the quotes that you posted, my words, the only one that remotely looked bad to me was the one where I talked of my first boss. The others just exhibited minor bouts of aggression.
To clarify, when I got money from my first boss, ran up long distance and split, I still consider that he actually ripped me off. When he gave me money, he either reimbursed my airfare (which was part of our agreement anyways) or he paid me for my teaching. He didn't do both. And if I can screw him in the future I most definitely will.
When you screw someone over you better be aware that payback's a bitch. So many people have lost the concept of 'you reap what you sow'. One important lesson that those people who calculatingly exploit other need to learn is that sometimes you get it back much worse than you 'think' you deserve. At least from me. And that's to mess with their little cost-benefit analysis way of thinking where they will rip many people, but for a little bit, so they think they can do it forever. Wrong. These dolts don't have the nuts to rip someone for 100 million won in one pop but in their slimy way think they can screw 100 teachers out of 1 million each. If any of the first 10 people hosptalised the a-hole, they'd probably save the other 90 alot of grief. I just happen to be one of those people who would do it under the right circumstances.It could be on the spot. Or I could just smile when he blatantly screws me, give him my email and tell him to drop me a line on any future visit to my country. "Sure Mr. Kim. I'd love to meet up with you..."
And for the poster who called me an idiot with alot of time on my hands. You're right about having alot of time on my hands. But probably not right about being an idiot. An idiot doesn't try to educate him or herself as I've tried. And things are a wee tight at the moment so I'd say surfing the net for about 33,000 won, for a month of unlimited access, is better than going out and pissing away what little resources I've got on hand.
