|

So I am ending my contract at the end of August, I've been at my current school for a year and half. My contract says I should receive a full air ticket home on completion but I'm not going home, I'm getting a different job.
My school is trying to pay me only 70% of a ticket home on account of I'm not leaving the country. They say, that since I'm staying Korea, they shouldn't have to pay the full air fare. The price they have quoted is just under 1.6 million won, while what they want to give me is a shade under 1.1 mil.
I'm digging my heels in and am ready to fight 500 bones is alot of money to me. I'm gonna head to the immigration place but any one else had experience with this or know of what I can do to get full air fare. |

Tell them you changed your mind and will be returning home. Buy a fully refundable ticket. Give them a copy of your ticket and receipt. Get paid for the full fare. Pay 30-50K cancellation fee and get your ticket refunded. |

Gepik contract:
6.If Employee completes the Term of Employment without the intention to renew and leaves Korea within 10 days from the expiration date, Employer shall pay the airfare for Employees one way return flight.
So with GEPIK you have to leave the country. The above posters advice should work just fine though. |

Whatever BS posted on this forum about Korean inadequacy, the lawyers who drew up the contracts did a good job.

People find ways around contract wording, that happens everywhere, but IMHO they are well constructed contracts. Not agreeing with the terms is another issue.. |

My contract says nothing about leaving the country and in fact says they will give me the cash in lieu of a plane ticket. So its not the wording of the contract its just going back on their word. |

Get the full amount. If you allow them to shortchange you, not only will you get burned, but so will the next guy. Settling for 70% establishes a pattern, and if the next guy agrees, that will be positive reinforcement. The third guy in line may be ME, and I won't budge. I will want 100% or we're going to war in court. A contract is a contract...at least to me.
Some things you can overlook, as Koreans think contracts are bendable. This is especially true when it comes to little things throughout your committment period. However, your situation constitutes something 'major' in my opinion, plus it has the potential to establish precendence. What is more, you are leaving the job.
Insist on getting 100%. |

You mentioned that you have been at your public school for 1.6 years, but your school is refusing to pay 100% of your airfare. I just completed my 1-year contract with my GEPIK public school today, but I was informed by my public school that if I renew for only 6 months, not 1-year, they won't pay my airfare. How did you get your GEPIK public school to pay 70%/100% of your airfare, when you only renewed your contract for 6 months, not 1-year? |
karin,
it sounds like your school is deliberately trying to confuse you with the contract. i believe the GEPIK public school contract says something along the lines of: if you renew, but leave before 6 months into the renewed contract you owe them the airfare coming back to korea after your home leave between contracts. if you leave at 6 months into the renewed contract, you'll only get the airfare back to korea paid for.
you completed this 1 year contract, so they owe you airfare home at least (doesn't matter if you renew or not... that return airfare is yours)
edit: the OP is talking about just getting cash back for the air ticket, which may be difficult. if you completed a 1 year contract and are heading home, that return airfare is yours. |

Read the small print of your contract first.
In recent years they've changed the wording regarding return airfares.
Nowadays its something like:
"Employer will pay employee return airfare home only if he/she is definitely going home. For those staying in country, free airfare does not apply".
Your mistake may have been to mention at all that you would be staying on here. |

Why didn't you get your cash when your one-year was up? Or were you leaving it up-in-the-air whether you were staying or not?
Maybe they expect you to dicker and will come up to 85-90% when you try to put your foot down. Would you settle for that? |
