Hi there,
I'm having to seek new employment from my hwagon after things did not work out, and I'm hearing coflicting reports on the criminal background check. I read that I would not have to get a new background check done since I already had one and I did not come over until March 2008. However, my recruiter is telling me I need to get another one done anyway.
So, my question is how do I go about getting one now that I'm over here? Is an instant one where I just put my name in alright or am I going to have to get fingerprinted again? If so where do I do it and where do I send it?
I am American, and from the state of Maryland so anyone having any advice what the laws are for this would be a great help, thank you. |

| From what I remember people saying on here, you only need to provide immigration with you CBC once. After that it's not required. If I were you I'd call immigration and get it from the source! |

Well, I don't know if you actually need another one with any certainty. The website does say this:

Someone will come along and clear you up on this point I am sure. However, if you are going to leave the country, you may very well need to get another one. Again, I am unsure on this point.
However, I am also from Maryland. While I haven't done the background check from Korea, I did do it from Thailand recently in preparation for moving to Korea. The online checks are no longer being accepted by immigration in Korea. Therefore, you need the real deal. For me, that meant fingerprints being sent to the states. They were forwarded to the proper state agency. My family got them back in about 2 weeks. Then, they were sent for the Apostille which literally only took them 2-3 days somehow. It was in Korea with my employer 3 days later.
My understanding is that you can skip the Apostille step if you are in Korea and can take the CBC to the embassy to have an affidavit prepared that states you are not lying. This is more expensive than the Apostille. Since the turnaround time in Maryland is so quick, I would go that route.

| This is true. I just recieved my FBI CBC and I am going to Seoul to get an Administration of Oath. I'm told it takes about an hour and costs 30,000 Won. |

No, I'm most definately not working at the same place. I'm looking for another job right now.
My question is do I need to get another criminal background check for a new job and if so, how?

| Immigration changed the rules so that online CRC's are no longer acceptable in any circumtances. You must have it from your country. And you dont take an oath, it's you signing a peice of paper saying you are who you are and the embassy notarizes it. So you do it at the embassy. There's a sticky about this above. |

Online checks are no longer accepted. The Oath or whatever would be done at the American Embassy. |

Nothing anymore, sorry if it wasn't clear, I was just clarifying my original post for spliff. Thank you again for your help, it's been great.
I'm going to call immigration right now to make sure I even have to do it again. |

If an online check is not possible, what is the fastest way for a U.S. citizen to get one (state of California)? I read the sticky on the subject and, as with most of the stickies, it brought up more questions than answers.

| Getting a local check from your police department is sufficient enough. Have someone from home do it for you. Have them apostille it also. |
