What do you guys think for US CBC ?
I was arrested, booked at the station and blood tested for intoxication.
Test came back negative and all charges were dropped.
Do you think it will appear on my US CBC from the FBI ?
If so, do you think it will prevent me from working here another year ? |

You don't need the FBI check. Just get a local one. |

Even if it did turn up it probably wouldn't matter. I have a record and was able to renew my visa without any problems. As long as it's not violent, drug related, or sex related, you should be fine. |

I can't get a local one because I'm in Korea.
I requested one from the FBI. |

Depends on what you were intoxicated by. They will be a lot more forgiving if it was alcohol than something else. I thought you meant some kind of drunk driving offense. |

I drank 4 Mountain Dews and 2 grande coffees, and the cop was sure I was tweaking. Anyhow, I'm not sure how Korea Immigration is going to view a DWI (driving while intoxicated) even though the blood test cleared me. the blood test won't be mentioned.
The report will state DWI -- charges dropped. |

I'm guessing you'll be fine. As long as the record doesn't state that there was suspicion of you being on speed or something like that I don't imagine there will be any problem. They'll assume it was for drunk driving and as long as it says the charges were dropped then it shouldn't cause you any problems.
Of course, I'm not the guy working at immi who just had a bad day and feels like taking it out on a foreigner applying for a visa.
It might help if you had the school you're going to work for write a letter to immigration to go with the record check stating, in Korean, that no formal charges were filed. |

You should be alright. But I wonder, as one gets mixed signals here. Some say NO ARRESTS is the only valid qualification. Others say you can have a record, just nothing involving violence, sex, or dope.
Which is it? I think it does come down to the particular consulate or immigration official.
Has anyone ever entertained the notion of an appeals process if you're denied a visa? There should be such a route, just in case one is denied over situations similar to the OP's.
Good luck, Dolan. |

If no charges were filed, it is unlikely to show up... and if it does show up, you can get it expunged. When that happens, the record is sealed just as a juvenile record is sealed. |
