Here's my situation:

Many visa's ago, way back when, I overstayed my visa a couple of days so now I have a black mark with immigration.

As far as I'm aware, anyone who has a black mark on with immigration and want to get a new visa must return to their hometown to do the 5 minute interview. My current contract is almost up, and I was planning on renewing with the same school to avoid flying all the way back home for the interview. However, last minute the school decided everything was not kosher and they don`t want me to re-sign and renew my contract.

Is there any possibility to transfer to a new school the day after my current contract is finished - without extension? So if my contract ends Oct. 10th, can I start a new job Oct. 11th with a transfer, or do I need to extend my old contract first?

Also, anyone with stories about getting a new visa without doing the interview back home would be really encouraging right now. Is it possible to do the interview in Japan maybe? This only applies to people who`ve had a bad record with immigration for something like an overstay.

Serious answers only please - don`t tell me to go back home between contracts or take a vacation. I`ve got my next year planned out and I`d like to avoid an unnecessary flight back home if possible.

1) IF you can get an LOR from your current employer (or he is willing to go to immigration with you) AND you have your CRC and MEDICAL AND a new contract starting on the 11th you CAN effectively transfer your sponsorship to the new employer.

(Change of workplace + extension of status of sojourn to cover the new contract).

Since it appears that your current contract ends today (or were those just hypthetical dates) - when does your ARC expire?

It is most likely that you will NOT be able to affect the transfer today (unless your ARC is for a later expiry).

Because of the short time frame, unless you have EVERYTHING ready to go for a visit to immigration tomorrow, you will be making a trip home.

At least your current employer owes you the ticket home and the new employer will pay to bring you back. It might be inconvenient but at least it shouldn't be out of your pocket.

Thanks ttompatz for the quick reply. Yes, those were just hypothetical dates - my last day of work is November 20th.

So you`re saying that if I have a new employer lined up on November 21st, I can extend/transfer to that new school with no new visa? If so, that`s really good new my friend. It just so happens that I received my CRC in the mail yesterday. So all I need to do now is to find a new employer and take the medical.

When should this 'Change of workplace + extension of status of sojourn' take place - the day of, or can it happen before hand? Can I do this tomorrow if I have a LOR stating my last day of employment?

Yes, you will need an extension. They are free. IF you dont get one you will be overstaying.

Theoretically it is possible to add the new place of work, change the sponsorship and complete the old job in the new employers extension PROVIDED both agree to it AND immigration allows it (like working 2 jobs).

In practical terms, you just go from one job on Tuesday to the new job on Wednesday.

Ideally you should be able to add the 2nd job as a 2nd job, change sponsorship then remove the 1st job when it completes (and do it any time during the last 60 days of your contract

BUT the reality is that most immigration clerks are a bit lazy so..

You will probably have to go with your current employer (and documents from your prospective employer) during your last week of employment and simply move everything from your old job to your new one (which would effectivly make your last few days of work at your old employer illegal since your sponsorship is moved to your new boss as a simple change of workplace.

What I was saying is the process is:
Add the new workplace. (60k won fee)
Change your sponsorship.
Delete the old workplace.

When you add the new workplace you will also have to apply for an extension to your status of sojourn (and pay the 30k won fee) so that your ARC will match your new contract.

You CAN have both workplaces valid for the required few days IF the employers are willing. This would entail your stopping by immigration a 2nd time to cancel the 1st place of employment after you start the 2nd job.

It should NOT do anything to nullify your previous benefits unless you leave early. Be aware that your contract with your first employer may not include the flight home (or cash) if you don't leave Korea. Also be aware that your new employer may not be interested in paying you for the flight that you don't take either.

Be very careful when/if you get/need an extension of your current visa...I got one for 2 days as was no flight sout on my last day and they wrote FINAL EXTENSION on the back of my ARC....which effectively made it ipossible for em to do the transfer thing, despite having all docs. Wasted a month waiting for new visa from scratch.

Just an update:

Well the good news is that my school's HR is willing to cooperate with transfer. The problem was explaining the part about allowing a 2nd job. The guy I talked to said he'd done transfers before and all that I needed was a LOR. I told him I'd send him an email with the details.

Now all I need is to find a new employer and my health check. Can I get my health check on my own without the employer? What forms do I need and what's the cost?

The hospital I went to had one form for everything. Along with the basic medical check, I had to get a TBPE (but there was confusion on what this meant and I am not sure I actually got this) and HIV test. It cost me 40,000 won and was completed a week later. You can also go to places which only need 2 or 3 days.

입국 후 외국인 등록 시 국�공립병원, 종합병원 등에서 발급한 건강진단서 제출 필요
- 검사항목에 마약복용 여부 검사를 위한 TBPE검사, 에이즈 감염 여부 확인을 위한 HIV검사는 필수 항목임
▶ 마리화나 복용여부 확인을 위한 카나비노이드 검사는 삭제

Submit health examination records upon applying to be a registered foreigner after entering Korea.
※ “Recruitment health exam” MUST include TBPE test(tests for drug abuse) and HIV test (tests for AIDS) results(cannabinoid test for Marijuana need not to be included)
