Will a couple of alcohol- related misdeameanors from 15 years ago prohibit me from obtaining a E2 visa to work in the ROK?
Some people have said absolutely NO criminal record; others have said as long as no felonies or crimes involving kids/ sex/ drugs, etc ...
What's the deal?
I know this has been discussed ad nauseum but this is quite important.

Your CBC should include an arrest record. Use a local police station and it is likely that it won't go back far enough to matter.
Unless you're canadian then everyone assumes you piss labbat and drink maple syrup (or vice versa). |

| Possible. But each immigration office interprets the "law" differently. It, like the hagwons, is a complete crapshoot. One place might reject you, another might say no problem. Who knows? It's too bad that immigration can't have one defined set of criteria that they follow. But this is Korea and they usually do everything illogically anyway. |

I wish I knew that answer. My guess is that it depends on the whims of the particular immigration officers and what the office is told by the higher ups. There is no clear answer on that. There are some people here with visas who have misdemeanors, and I believe there were some who were denied visas. It is stupid to hold people for DUI offences that are old, because many Koreans have those, but, then again, an American with a DUI is inadmissible in Canada until he or she pays around 200 dollars Canadian in order to enter. I know of a story where one immigration officer allowed someone with a DUI to work since he was in Korea for a while, didn't harm anyone, and it didn't appear to be serious.
Can you, however, count on uniformity of treatment? I am not sure. |

If you have ANY criminal record, you cannot count on getting a visa. There's always the outside chance that you might get one in spite of your record, but you really shouldn't expect to get one.
Do whatever it takes to get your record cleared up before you apply to come to Korea. |

Doesn't a DUI show up anywhere? If you have a misdemeanor in one state won't it show up somewhere else? As for me, I have a misdemeanor and did the check and was accepted, and I haven't left Korea. I may transfer my visa. If I have to do a check can't I just do a Korean one since I haven't left Korea except for a brief visa run some months ago? |

Internet checks are not accepted because they can't be guaranteed to be fully accurate. Only a real law enforcement office can get that information directly. If you have a criminal record and it shows up, then you may very well be SOL.
In reference to your last question, I'd suggest you have a few beers on the plane & introduce yourself fully in the welfare line.

| None of the agencies share information. Order one from the state, local and FBI. They will all have different information (if any at all). This is a real problem in the US but may benefit the poster wondering about a DUI. Have you never seen on TV someone wanted in one state was arrested in another but they didn't find the outstanding warrent? |

Chicken, is there something wrong with you? I have a teaching certificate. I could get a job in the US or Canada teaching French or social studies since I am a dual citizen. I am in the midst of applying to grad school. What have you planned out for your future before you keep on acting as if you are some big thing, when you just aren't. Why don't you take a hike? If you have some psychological issues to where you have to constantly attack other posters, I am sorry but I don't have the number for a shrink, but I wish you the best of luck. Anyway, if you're all high and mighty tell us all about your 6 figure salary in California.

| I wouldn't worry too much about it. I was very concerned about it when I ordered my criminal check. I have a MIP (For alcohol) when I was 18 and a drinking in public ticket from a college tail gaiting party from 5 years ago. Got my FBI criminal check and it said "No Arrest Record." No problem. If you weren't arrested I wouldn't worry about it. |
