|
|
My contract finishes on the 7th of December. I fly out on that day. My Visa finishes that day too.
School is refusing to pay severance on Friday, my last day of work. They want to pay me on Monday after I've left!
Does anyone know the rules for when severance should be payed?
Should I get in touch with Dain Bae?
The problem is I need to get a Letter of Recommendation from the Principal so I don't want to start a war. (Although I think he's most likely just to fck me over given his other behaviour). Any thoughts?
Here's the timeline...
Friday 5th Dec: Last day at work
Saturday 6th Dec
Sunday 7th Dec: Offical contract end date. I'm flying home in the evening
Monday 8th Dec: When the school says they will pay the severance. |

You don't need a new letter of recommendation, at least I don't think so. All you need is a certificate of employment from the school on your last day to get another job.
You can use prior letters of recommendation you used for your current job, new ones are not essential for another job. If I'm wrong I apologize. |

Last day of a contract falls on a Sunday so they owe you the money on the Friday. If they were decent they would pay it even earlier so you didn't need to worry and had some time to do some banking.
I would never fly out that close to the end of a contract. |

That's not necessarily true.
This:
Quote: |
3. Employees salary shall be paid on the twenty fifth (25) of each month. If this day falls on a National Holiday, Saturday or Sunday, the salary will be paid on the immediately preceding business day. |
plus this:
Quote: |
6. Upon completion of a one-year contract, Employer shall pay Employee an extra 30 days average wage as a severance pay for Employees continuous employment of one year. |
doesn't necessarily mean they have to give the severance on the preceding business day. They're definitely being douchey though.
And, though we all want to get to that vacation spot as soon as possible:

If one wanted to be technical, one could insist it be paid on Sunday since the contract doesn't specify otherwise. Tell the school that if they don't want to pay you on Friday, you are willing to come in Sunday morning and get it in cash |

If one wanted to be truly technical, because it is not specified in the contract, they don't have to pay it until 2 weeks after your last day. As per the labor standards act the last time I looked at it. |

I messed up a little bit with my choice of flight. But my Visa was running out and I would be homeless 'cos I doubt the school would let me stay in the apartment a minute after the contract ends.
When did everyone else get their severance? Early? Last day? or late?

I've gotten it in cash on my last working day (in a hagwon), in my bank account on my last working day (in a different hagwon), and in my bank account the day after the last day of my contract (in a public school). |
