Right, I'm posting this on behalf of a friend as a matter of urgency as he hasn't been confirmed as a member of this forum yet.

Okay I'm a new to the whole international teaching scene in Korea and I'm pretty sure I'm about to get screwed over. I was rushed over here by my recruiter who failed to tell me he had made no progress on getting me my E-2. After a month here I have had to extend my tourist visa. I am now finding out that due to an alcohol intoxication misdemeanor (this is what you get in Kentucky if you walk home from a bar instead of driving) which I recieved 2 years ago that showed up on my CBC, that I am now possibly not eligible for an E-2. This has put both my Hagwon and myself in an awkward and potentially illegal situation. Now his solution is to make another attempt for an E-2 in a different part of Korea with another school. This is upsetting due to the fact that A) There is no guarentee that it will work.B) I don't think I have any chance of avoiding paying for a plane ticket home. C) I fear my current school is going to avoid paying me due to their own losses (even though I worked 4 42 hour work weeks due to the fact that I was the only foreign teacher) Is there any way to discuss CBC's with the Korean education department?Does anyone have any advice? |

He is working illegally now and if he is discovered by immigration it will all be a moot point.
A fine and exit order or detention and deportation would be in his future.
IF his CRC has been filed and an E2 denied it won't make any difference where he applies. This is an immigration issue and not an education office issue.
If his CRC has NOT been filed then try to get one from another state.
He may have to go home for his consular interview instead of a simple visa run to Japan if :
a) this is his first E2 and
b) the employer can't get his degree confirmed by KCNU,
Wait till the day after payday and head for the next country down the road.
Any school that is willing to use illegal workers would also have no qualms about not paying you if they suspect you will leave soon. As an illegal worker you would have NO legal protections if this is the case.

Life is filled with bitter ironies, isn't it? Can't teach in Korea because of a D & D in his CRC. |

God, that sucks.
Why do the authorities put something like that onto someone's record? |

Maybe because it's a crime?
Public drunkenness may not be as dangerous as, say, DUI or DWI, but it's shameful and unnecessary. I'm all for Friday night at the bar, but there's no excuse for the kind of gross excess it takes to warrant police attention.
I don't agree with a lot of policies at K-Immigration, but I don't fault them for rejecting a teaching candidate who has demonstrated profoundly irresponsible behavior. |

Doing a runner is an option.
I mean, the best possible outcome is looking more and more unlikely. If it's already been rejected, it's in the Kimmy computer - and you'll have a hard time going further. Even if you're granted the E2, you may have to do the consular interview (in new zealand). More likely, you'll either be rejected the E-2, found out you're teaching illegally, or both. Any combination of those will require you to board the next flight home, with or without supervision.
I like to be positive whenever possible, but you're paddling upstream.
(replace 'you' with 'he' if actually applicable) |

I agree with those that said pull a runner. Don't stay at a school that employs you illegally.
If you don't want to go far, you can go to China and try to work there or wait it out to get a new, LEGAL job in Korea. |

Forgive me for taking the bait ... but that's got to be the most enormous amount of judgmental speculation I've read on this board in a long time. |

If you weren't arrested then I would try and get the FBI check. I have two small misdameanors from my university days for drinking. One was an MIP and the other an open intoxicant from tail gating before a football game. When I got my FBI check it said "No Arrest Record" and I was good with immigration.
As to your recruiter he is crooked as sh@*. I would bail on him. No way would I ever come without having my VISA. It's just asking to get screwed over. I get a feeling if you do get a job that immigration would want you to go home for the interview. I may be wrong. I know they still do VISA runs so you could possibly still do that. The best of luck to you but try and be a little more cautious next time. |

This is why you shouldn't come to Korea until you have your E-2 Visa in your passport. |
