|
|
My employer (Public School) desires or insists to retain 600,000 Won in the event I do not pay my bills and leave early or fail to pay them upon contract completion. All other foreign teachers have agreed. The school paid for their air fare - they did not pay for mine which in my mind makes me a different case. If the others quit and leave, the school is on the hook for air fare. My bills are about 150,000 monthly so I said to them that I think 600,000 is a bit extreme. I got a blank stare. There is nothing in my contract stating they'd withhold salary. I think it is breach of contract without just cause.
Now nobody likes having money withheld but is their request reasonable. They will give it back upon completion of contract so they say but still I could use it now and I am responsible enough to pay my own bills.
Thoughts? |

Who are you with SMOE, EPIK, GEPIK?
Most public school contracts withhold 600,000won taken over the first two months and returned at the end of the contract. Teachers who are renewing are excluded. If it's in your contract and you signed it, then you have to stick with it. If it's not there, then you need to start waving that thing around the admin office and screaming about the labor board.
That 600,000 isn't necessarily there to cover your debts but also to compensate the shame caused to your principle by your running. At least 10 trips to the room salon there. |

Sounds like they gave you an old contract. But if you and they signed it, then it's legal and any deductions to wages would be a breach of contract. |

With GEPIK they have a 900,000 won "security deposit" even if you have your own housing. If it's not in your original contract, you can try to get out of paying, but most of the new contracts these days require you to give the deposit. Make sure to get EVERYTHING in writing. Don't trust word of mouth deals at all |

Dude (or dudette) said ti wasn't in the contract.
OP. They can't take money that you don't agree to, regardless of whether it's standard now or not. Tell them to get stuffed. |
