Hello, recently my contract has ended. My boss owes me final pay, pension and so forth.

My school contract ends 12/12/2008, but my visa expired 12/8/2008. So I went to imigration today and they charged me 100,000 won for a 14 day extension. They said its a temp resident paper. That was at the Dague imigration.

The lady also said EPIK had all my paperwork and that by Friday I would have all my paperwork, so Monday I have to go to pohong, give them papers and get my new visa.

They said I dont have to leave the country even though visa is expired. I just get new visa in pohong.

But here is my question. How does one go about getting there pension or knowing they will get it when they leave year 2-3. I guess you have to leave korea to get it. But if you transfer schools, do you just wait tell you leave country perminatly?

Does the new employer just pay into your pension fund you currently have?

I am a little confused on that, so any advice would be helpful.

On the plus side should seen my bosses face when I told him I couldnt teach today as I was illigal due to his bad written contacts and visa.

It seems to me that you overstayed your visa by three days before going to Immigration. Are you sure you did not receive a W100,000 fine and a 14-day exit order?

This is what my paper says:

Your application has been received. Required documents, however should be submitted to Management Affairs Division of this office withen 14 days of 12-10/2008

Recipent: The hoplder of the Orignal receipt of Applicant himself

This is the paper they gave me after seeing my Uljin contract for public school. They verified with my recruiter I will work there.

And no 100,000 fee even though I was 2 days over visa. I thought it was really nice if it all works out right, I dont have to leave the country for a day or 2.

My boss was stupid. He had my visa start date 12/21/07 to 12/8/08

The contract he gave imigration at the time was dated 11/30/07 to 11/30/08. SO really i was 10 working illigaily and two days obver my visa.

On a side note my contract said I would make 2,000,000 a month. He took out 140,000 a month for tax.

We went for pension today. they say theres 1.1 million in it
He trells me he has no money for severence pay
And the money for the plane ticket for me to go home, he used 1.3000,000 to pay a recruiter for a new teacher and 1.2 million to pay for a new teachers airfare tha wont be here until after new year.

I have my contract. Is there anything I can do to make him pay my airfare, and my severence? Or even bring over charges to the taxes he charged me that are extra?

Here are the few points of the contract that are revelent:

5. COMPENSATION AND OTHER TREATMENT OF EMPLOYEE

5-1 Transportation: Employer will purchase for employee an economy class ticket for passage on a regularly scheduled airline to Korea from an international airport which is mutually agreed to by employer and employee (henceforth referred to as point of departure). Employer will fully reimburse the cost of the ticket within 7 days from the employee�s arrival date. In the event that employee chooses to arrange his/her own transportation to Korea at commencement, or from Korea after completion of employment, employer will pay employee the equivalent of the cost of the cheapest economy class ticket to or from employee's point of departure.

5-2-1 pension: Both employers and employees agree to paying each 50% towards the newly-organized foreigners� pensions. (However, when employers pay foreigners' and the contract expiration is done, foreigners agree to reimbursing the airplane ticket, severance pay from the reimbursed insurance.)

Severance Payment : Dependent upon completion of the full contract period, the employee will be given an additional 1.9million Won (less severance tax) exclusive of monthly salary payments. In the event that the employee does not renew or extend employment under a subsequent employment agreement with employer, this payment will be made at the time of completion of the contract period.
