Foreigners Can Cite Adultery Law Here

The Supreme Court ruled Tuesday that a foreign national has the right to ask the prosecution to prosecute his or her spouse if the latter has an extramarital affair in Korea, where adultery is illegal.
It means regardless of nationality, those who have a sexual relationship with a married person here can be subject to the law. Violators face up to two years in prison.
The top court upheld a lower court's ruling that held a Canadian citizen's husband guilty of having sexual intercourse with a married Korean woman. The husband was accused of three charges -- committing adultery, physical assault and threatening his spouse with a blunt weapon. According to the court statement, the 60-year-old Korean threatened his Canadian wife with a blunt weapon and assaulted her in March 2004 and had a sexual relationship with a married Korean woman in June 2006.... |

I don't know who that canadian woman is but kudos to her for standing up to that ajossi she had the ill fortune of marrying.
While it's a good ruling, the fact that it even came into question is a bit frightening (but not surprising, sadly). |

There was that guy whose wife left him, took all the money and ran off to Australia (I think) with some other filthy foreigner...whatever happened in that story? If I remember correctly, he couldn't get a divorce...or renew his F2.  |

| So what if a foreigner's foreign spouse committed adultery with another foreigner in Korea - could the adulterer / -ress be charged? And don't forget that a Korean can be charged with violating a Korea law overseas (remember Almondtease?). I wonder how many Koreans have committed adultury - one million? Ten million? Now that the law's been clearly demonstrated enforceable I wonder how many more ridiculous cases we'll see. |

Well. She was studying english in Canada and did some porn to earn cash. She fk'd a lot of white guys. Anyway, she went back to Korea and worked as a hagwon teacher. One of her male students *quite innocently* stumbled across her photos. HOLY CRAP THAT'S MY TEACHER TAKING UP THE CORN HOLE BY A MEEGOOK WITH A 12" GOCHU!
He dutifully reported her. She was arrested and Korea determined Korean law applies to Korean women doing something legal in Canada.

I have to say tho even in Canada I've seen a lot more attractive Korean women. If she wanted to pork me, I'd do her in a second but I'm not really sure I'd pay cash money to watch her get it on. |

Almondtease was an ESL teacher?
No freakin way!!! 
If I saw her in school.....my first thoughts would be......whoa!
I'd have a thousand and one questions to ask........inculding one that closed his kickass bar and moved back to Canada.......
Other than that, a friend in Iksan said that there were a rash of divorces as many foreigners divorced their Korean spouses because they were caught cheating on them.....
....I wonder how many would use the ruling as a vendictive way to get back at them for doing that.......?
and at the same time, how many Koreans would start turning in their foreign spouses for cheating on them.......?
And while we are at it....how many couples will turn in their spouse because the other cheated on them with a foreigner?

That was me and she is still in Australia as far as I know. I finally found a lawyer that will help me get divorced. He filed papers with the Seoul family court today and we are waiting for their reply.
Immigration is giving me three month extentions on my F2 until the divorce is final. If the court rules that the divorce is her fault then there is a slim chance immi will let me keep my F2, but it is more likely that I will have to go back to an E1.
As for the adultry laws, I filed a missing persons report with the police, (required by immigration to prove she is not in Korea) but the police refuse to file charges against her for adultry. They say it is because she is not in Korea. The officer who did the missing person's case said I have to call him when she comes back to Korea and then he will take action (like I will know when she returns).
