I was denied a visa yesterday over a pending traffic ticket. I was told even if I clear my record that I still couldn't get a visa.
Is there anything I should do? I keep hearing that I should just apply for jobs in japan....but I was kind of looking forward to working in seoul
any advice is welcomed. |

i had replied to your post in the travel section, and was hoping you would provide more details about your "traffic ticket." supposedly, traffic violations and other minor infractions are not considered detrimental to your visa application. what, exactly, is the ticket for? i ask because i had an unresolved case on my criminal record - with a "failure to appear" in court (related to driving with an expired license). maybe you could let us know a little bit more about your situation, and someone could help you out.
edit: who told you you wouldn't be able to get a visa if you cleared your record? the consulate? you might want to try asking them a few of these questions. they would be more qualified to answer them correctly. i've never heard of someone being denied a visa after their record has been expunged. |

well I was pulled for doing 15 over(which is big in NC) and driving with an expired license. When I sent in my paperwork everything on the background check was pending. immigration saw that and they asked my company about it. After a few days my company said there was no talking them out of my denied status.
I had a court date coming up on the dec 22nd. My background is cleared now. There is nothing on my report. But my future employer stated that the Korean immigration doesn't care. They said since it was once on there and they saw it, I am still denied. That to me doesn't make any sense. All of my charges were dismissed and I am still denied?!
Doesn't anyone know what I can do from this point? |

Perhaps you'd be approved for a visa by an immigration office located in a different province?

Hi,
If I were you I would try submitting everything again with a new criminal record check showing nothing pending and no charges. It may mean having to find a different job and new employer (if it is him who is saying Immi wont budge). Chances are you will start afresh and no one will realise you have been denied. |

so they don't track all of the denied E2 Visa people? I am looking for another job, but I got kind of scared when I read somewhere that I will not be able to EVER get a visa due to this situation. So it is not true that Korea gets a hold of your CBC that it will be known in there immigration system?
Maybe I should apply to a school outside of Seoul...... |

You need to learn that when Korean employers aren't lying they are simply getting it wrong. Don't take what your future employer is saying as fact. Check with immigration/Korean consulate yourself. Or just try with a new employer in Seoul and see what happens. |

Well let me just say i had 17 tickets on my drivers license for various infractions.. mostly speeding and parking that went back to 2006.. i just paid most of them off the other day. I never had problems with my visa back in march.. but then again i've never had a ticket for driving without a license.. maybe thats different. |

In most US states driving with an expired license is an infraction. In Korea it is a criminal offense. That may be the problem. |

if your record is clean, then you won't be denied a visa. korea is notorious for being unorganized, and does not keep track of the criminal record checks (which is one reason why we have to submit them every year). search and apply. don't mention your precious denial to prospective employees/recruiters. you'll be fine. good luck!
p.s. i'd make a guess that you were denied because the case was pending when you submitted your check. to immigration, it might have looked like you were shirking your responsibilities and running from the country (laughable over a traffic ticket, but plausible in korean minds). |

IMMI might also have confused "expired" license with "suspended" license, dunno.. if you're driving on a suspended license you're in big doo doo indeed.. |

Find another job in another province and reapply. I bet you'll be fine. You're clean now, so there shouldn't be any problems.
Good luck, and do keep us posted. |

I'd make a guess and say the employer was lying to the OP(chose another employee and for some stupid reason lied to the OP). What a low down thing to lie about too, but I wouldn't put it past any given Employer/Recruiter. Another poster mentioned not to trust the employer as well. "Tobias" gave good advice/suggestion, find work in another province which will mean you'll deal with a different Immigration office. |
