Labor law - 10 days holiday minimum?

I've just received the calendar of my working days for 2009. I started work in Sept 2008 and I am due to finish in September 2009. If I total the days off for vacation it comes to six! I thought there was a minimum vacation of 10 days per year..is this correct? Is it the calendar year or working year?

Actually, it's 15 non-Red Day/non-weekend days, all within the 1 year of your contract.

Any opinions on the best way to approach my boss with this? Will the labor board back me up? (I'm currently not paying any pension).

Print out the labor laws from the Labor website, highlight the relevant clauses, then leave it on his desk and ask him to please fix the situation. If he refuses, get a Labor official on the phone (1350, ext 7), explain the situation to him, then hand the phone to your boss so the official can explain the situation TO HIM.

Pension is a different animal, and you need to see someone at the pension office for that.

Thanks for this. I notice 7-10 paid vacation is mentioned on job advertisements on Dave's. So I expect I can take a few extra days holiday but they will be deducted from my salary if they don't fall within the 7-10 paid vacation days.

You forgot about the sucking in of air as he "thinks about it" before saying it is impossible.

The Labor office telephone dude will simply tell him Saturdays and Sundays are not counted as vacation days, and neither are Red Days.

I want to 'in on' the first Labor Board 'test case' for the new, 2009 EPIK contracts that change 14 working days to 21 calendar days. Twisted Evil Laughing

No, because the contract contains the provisions that ten calendar days are taken in summer and eleven in winter.

The ten calendar day block will only give eight working day off if one starts the block on a Tuesday and ends it on a Thursday (assuming there is no statutory holiday in the block). Who the hell wants to work the Monday before their holiday and the Friday after?

So, 21 calendar days can mean as many as 15 working days, or as few as 13 or less - if the employee is stupid enough to go on holiday during lunar New Year or Aug. 15. One will not be able to extend one's holidays by combining contract holidays with statutory holidays.

For the vast majority, it will in effect, mean one less day of holidays. The Ks aren't stupid; but they know the new crop of PS newbies are. Wink

What does the new contract say about renewal leave? Do you still get the additional two weeks if you renew? I only care about the EPIK contract.

Yes, the two weeks 'home leave' for renewal remains unchanged.

Remember - only one more 'kick at the cat' to fly anywhere in the world (equal to or less than the distance home, no matter what the cost) for renewal.
