A colleague of mine wants to know if her school owes her 30 days' notice/ a month's salary if the outfit sacks her with 6 weeks left in the contract.
I'm not sure if she's entitled to anything.
And....what if she's sacked with 3 weeks to go?

If she's fired three weeks prior to the end of the contract, then it is incredibly obvious--even for the joke that passes for administrative justice in Korea--the school is pulling a fast one ("12th month firing").
Besides that particular issue, the school is required by law to give either 30 days notice or 30 days pay for termination. |

...and contact the labor board to file a complaint for 11th month firing. Make sure your friend gets a termination letter from the boss. |

If the teacher was fired for gross negligence, then 30 days notice and pay are not required. This would have to be documented with evidence to prove it. However, it doesn't sound like that is the case.
Go to the labor board and get their help. Make sure she gets a letter saying she was fired, otherwise the employer might file a report saying she quit. If your friend is planning on staying in Korea, she can transfer to another school, provided that the first school signs a release letter. They will have to notify immigration that she no longer works there. |
